Resolution recommendations....

...so about a month ago my wife was in a car accident....she was rear-ended at a stoplight....the other driver had an insurance card, but it was 2 weeks expired.....my wife called the cops and had a report filled out.....

....we contacted his insurance company a few days later (mid December)....we just found out that his vehicle was not insured at the timeĀ  : :mad:....which means

....we did not have collision....so our insurance won't pick up the bill either :cry:....

....I got an estimate today....$5,112.00t (the car is a 95 Saab).....with a possibility of additional costs if more damage is found under the surface....considering the car is only worth about $5500...what should we do??....


...should I contact him about paying for repairs or buying the car outright??....should I be prepared to push the legal issue, as in get a lawyer, considering this is above the amount that small claims allows...or is there something else I should do....thanx all....




ps....I will never again go without collision coverage....

I hope your wife is doing well.

A friend at work got into something similar.  He was legally taking a turn, when a guy just scraped his car into my friend.  My friend didn't have collision, and guess what...  The guy didn't have ANY insurance.  My friend took the legal route.

I suggest the same.

poor situation but you may be screwed...to put it nicely.

Personally, pursuing the matter privately will get you nowhere...I know for a fact.  Some boob hit me a couple years ago in a parking lot then claimed it was my fault with his insurance and has been trying to get me to pay through private organizations since.  Not seeing a dime.

Your only chance is to get a lawyer, pursue him in court and likely force a hold on his assets until he pays or settles.

....I gave him a call, and left a message on his voice mail....I'm thinking about getting a lawyer....anybody know any good ones??....

I don't recommend called him directly beyond this point.  Any interaction between the two of you should be in the presence of lawyers.  Mainly to protect yourself.

Good man!  :thumb:  Just be sure she stays feeling fine. Some injuries develop later (and I don't mean the fake kind..I mean the legitimate kind that deserve good medical care...which is why the law says we carry insurance (depending on your state)....don't get me started on irresponsible lowlifes who cause others pain and grief...)...

I hope she stays fine and dandy and hot-tubbable!!  :icon_mrgreen:

Just to let you know, collision insurance may not have covered you anyway...  You need "Underinsured/Uninsured Motorist" coverage...  Covers you for hit & run too...
