i got in to an accidient last monday. so you don't worry i'm fine with road rash on both knee's. man those white pills help alot. anyway to the ?. i know it's the law to report to dmv within 10 in lost is over $750. i can't get into a dealer till next tues to get estimate of repair. i know it will be close to the amount. what should i do? also if you have experienced this what have you done?

now what happens then they total your bike? do i get to keep my bike too?

pantablo

if you think its going to be close to $750 its probably 3x that to the insurance co...was it single vehicle accident? more details please (photos would help). bottom line is that you have 10 days so dont sweat it yet. wait till tuesday... thats only 8 days.

only thing that make me upset is that i only shut down 3 lanes of the 91 west. no enough pay back from the time i got stuck in traffic with not where to go. i felt better after i heard 1hr later the whole 91 west was shutdown from another one.
forgot to add i rearend him but, it was a hit and run.

Alphamazing

Wait, so you hit him, but he ran off? Hmm. I wonder if he's at fault then.

Caturday yet?

If you rear end somebody, it is your fault.

The insurance company will determine that you failed to keep a safe distance, stop, slacken speed, keep a careful watch, or swerve.  There is basically a presumption that you were at fault.

Sorry.  The good news is your bike looks pretty good.  Pretty much cosmetic, right?

Fix the other stuff...  But, keep the pipe like that... Looks good!   :thumb:

I'm not sure if this is true (I'm sure someone will let us know), but I thought that leaving the scene of an accident basically changes the view of the accident in the eyes of the law and more-or-less puts you at fault. :dunno_white:

weaselnoze

i think its unclear WHO left the scene.  the other guy or kimo.. :dunno_white:

It exposes that person to potential criminal liability, but I don't think it is sufficient to overcome the presumption that if you rear end someone, that you are at fault.

Any time someone rear ends another party, that person is ALWAYS at fault according to the insurance companies.

about four years ago, I was trying to pass this truck, so when I make my move, he swerves to block me!!  I had to enter our lane again, but before I could react and back off, he slammed on his brakes.  My truck was totaled, and insurance went up.

The only thing that happened to him was his parents scolding him for being a d*ck like that.

pantablo

if insurance totals the bike they keep it and pay you market value. they also might offer to sell it back to you for cheap or if they dont you can ask about that, but it affects the title differently. In CA, the title would change to a salvage title. harder to insure sometimes and harder to sell.

kimo3825

aren't you able to get a inspect from chp and clear the salvage and get the regular issued title?

pantablo

no, salvage title is permanent in CA.
