Can they do that?? I assume they would just file a judgement against him in the amount of what he owes.  Can they really repo it from another buyer? How much would that suck? Imagine if you bought and paid for a bike to someone else, and it got repoed? Would you be out all that money or would it get returned to you? I wonder what would actually happen? If that jackass sells the bike, he does not have a title to sign over.  So, if the buyer accepted just a bill of sale, the lender would absouletely repo the bike, regardless of whose garage its parked in.  The lender, and the law would not recognize the sale as legitimate as the title was not transferred.

  ... and with a lein against it (from the financing co.), even if you DID have a title / pink slip you'd have to accept responsibility for the lein before you could register it in your name.

  In Ontario, it's required by law that the seller purchases a Used Vehicle Information Package to show potential buyers.  It's then the buyers responsibilty to review that document, make sure the current seller is the last person on the list, and ensure there are no leins against the vehicle.
