Have any friends in the legal business?  A phone call from an attorney (or at least someone who sounds like an attorney and has a good knowledge of the law ;)) has usually cleared up just about every little 'hiccup' I've ever had when dealing with private party sales like this.

Well I'm hoping to deal with this without bringing legal action near it.  IF the loan is paid, and the lienholder can release it, there's no problem I can get the release straight from them, hopefully.

If it's NOT paid, then we're going to have a big problem.

Same here.  Riding the bike around the parking lot in full gear probably looks rediculous.

Better than not riding it at all!  :thumb: My good wishes for a good resolution, too. Hopefully it'll all be cleared up in short order, and you can get down to the business of riding!  :icon_mrgreen:

Don't let it turn you off from riding though. I bought my gs last May. It had less than 1000 miles on it and its a 93.  The poor lil bike just needed a new head, got on the board and had it fixed up in less than two weeks. When did I get to ride my gs on the road legally ? January. It sucked. My bike had passed through so many hands while it was broken that the NY DMV wasn't sure who even owned it at this point. The last time it had been registered was when it was taken from the dealer in Ohio. I put nearly 100 miles on it just up and down my driveway. That first trip out was sooo sweet. I spent the time getting to know my bike and bonding  :laugh:


It was worth the wait..i got impatient along the way and wanted to say screw it but now i wouldn't get rid of it now no matter what.

Well basically if this isn't resolved by the end of august I won't be able to ride until May.  Which is a fairly rediculous amount of wait time.  Not to mention, if he IS trying to screw me over, I have to go through legal shaZam! and pay attorney fees..  :cry:

I am faxing the lienholder today (might be done already my dad is faxing it from his office).  The holder is Household Retail Services, which I have not read flattering things about.  Hopefully I am faxing it to the right place, I went through about 3 automated customer service, and 2 people.. finally was told that the titles office doesn't have a phone number, and that I had to fax everything to them and they would get back to me.  So.. hopefully they do that, and hopefully they can send me a letter of release.

I figured it'd be smarter to ask the lienholder as well as go after the seller so hopefully one side will at least work out.

Well...if he really is trying to jerk you around, and you do take legal action, and you win, you can force him to pay your legal fees by rolling that into your lawsuit - because, well, if he had just kept up his part of the contract, you wouldn't have had to hire a lawyer and take his lazy, selfish ass to court  :2guns::thumb:

That is true but I still would like to avoid legal actions because they take so much time.  I have to go back to school in a month and a half.  Time that should be filled with riding.

Don't have the money, know how, a nearby track, or a way to transport the bike there.  It's not a viable option.

hope u get it resolved soon man.  my co-worker sold me the bike more than a month ago lost the title so we gotto apply to get a dup so i can register it n get the plate sticker.  for now i only ride it around the block at night :( another 4 weeks *sigh

He e-mailed me again today saying that the bank was going to send him another copy of the lien release (he couldn't find the one he had) and that he would snail mail it to me.

Isn't it possible for the lienholder to fax him a copy that he can then fax to you? You'd still want the originals, but at least you'd have some comfort that you WOULD get the items (and that they actually exist)?

Apparantly you have to have the original or a notorized copy in order to get the lien removed.  But I'll try for the faxed copy, at least.

The faxed copy is just to give YOU peace of mind while everything's in the mail. Otherwise, you're waiting for at least a week or so, still not knowing whether something will show up in your mailbox.  :cry:
