I'm not trying to scare you but this really has gone past the civil point and I wouldn't put any of the above past this dirtbag.  I'd highly recommend some sort of legal authority to be present.  I'll stay out of it from here on out but take care of yourself, I just don't see this being taken care of in a friendly civil manner.

I don't know if this sort of psychology would work on someone so corrupt...but....

Here in California, a vehicle (automobile/truck/etc) must pass a smog inspection BEFORE it is sold. It's the responsibility of the seller to do this. When we went to buy a truck from a trusted neighbor, we found out after exchanging $ for truck that he had NOT made sure the truck passed inspection (or it had failed, I can't remember now). Being reasonable people, we went over and talked to our neighbor after having microscopically disected the part in the DMV code that talks about our situation). Our neighbor wasn't too interested in doing the smog thang. He figured he'd sold it, so it was OUR problem.

I told him that I would just LOVE for it to be our problem, but since it wasn't in our name, we couldn't insure it. If we couldn't insure it, any accidents we had while driving it would be the responsibility of the registered owner (he said he'd cancelled the insurance "yesterday," so I pointed out how accidents can be...really expensive...they'll take your house if you're not insured enough!). We told him how sorry we were that the DMV was being so strict, and we'd sure like to be able to get it taken care of ourselves, but our hands were tied.

Within two days, he'd taken care of the smog repairs and test. ;)

Unfortunately, it doesn't sound as though this guy is reasonable, and I really think he's setting you up for a bad one...  :cry:

The problem is, if I keep asking for cash only, then he can just say well screw you then keep the bike and I'll keep your money.

I've asked for a signed letter with the bank letterhead from the manager of his branch that certifies the check as valid and that the funds will be available to me.

And if the check fails, I'll have a copy of his license and there will be a warrant put out for his arrest. 

Also, if the check fails, I can demand payment and if he doesn't, bring him to small court for the money and an additional $750.

If you can even find him and IF you can even get him to show up to court. He's gonna run and you're gonna get screwed.

Try as hard as you freakin' can to get him to give you cash.

Really ... think about what you said ... Check = cash ... if he intends to let you cash it that is ...
Also - the bank that holds his title, will be after him to make payments and after what you have said earlier - they know he's not got the bike ... so he skips and they will show up to take it ... guess what ... if its not there they drag him off to jail. So he's got no option ... he cannot let you have the bike. He has to get it back.

I started to type out a long response but I'm staying out. 

Demand cash.  If he says no have a lawyer call him. 

And for crying out loud don't give him the $50 if the deal actually happens.  Or, write a bad check for $50.  Like I said, this is no longer a negotiation, or shouldn't be anyway.

If he comes with a cashiers check call 411 get the number for the bank it's from and ask if it's a real check.  Also you should be able to call your bank and they will call the bank it's drawn on to verify.  There will be a sieral number on it.  Thats the only advice I can offer at this point, since he " feels uncomfortable ".  Aslo make sure there are no marks on the check. 

Personally I would take a trip up there with the bike in the back of a truck or on a trailer meet in front of his bank.  I'm just getting bad feeling about this one.

I'm betting he show's up after banking hrs with a check thats not good.  Hopeing I'm wrong on this.

Checks are bad. If you call a bank to verify a check, 99% of banks WILL NOT TELL YOU if the funds are available. Instead, they will verify that it is an open account. However, it could be an open account with $.50 inside. CASH ONLY. Man.. I wanna come out there and deck this motherf*cker in the face for you...

Certified / cashiers checks are different.  They are kind of like money orders, you go to your bank pay them the amount of the certifed check then they make a bank check for that amount.  When you deposit the check it comes from the banks account not the persons.  God it's 3 am and I don't think I'm explaining this too good.

Anyway sense he's bring cash thats best :thumb:  Stop by a store and for a couple of bucks you can get a marker to check and make sure the money's real  :icon_mrgreen:  Just to show him what you think of him.
