UPDATE on my Hit and Run Case...

I get to the courthouse today.

I see asshat's Lawyer.

I ask to speak with him.

Me:  I wanna know where my restitution check is.
Asshat_Lawyer:  We're gonna plead guilty and get 6 months probation today, and we're also gonna request a restitution hearing for April 3rd.
Me:  This matter has been stretched out way to long as it is.
Asshat_Lawyer:  Well, at the hearing, the judge will decide what (and if) resitution will be paid.
Me:  ...

What a f%$king @$$hole.GRRRRRRRRRRR  I'm sorry, but if asshat #1 didn't hit me, I wouldn't be in this hellhole.  It's bad enough asshat is still gonna be on the road, but now *I* have to take ANOTHER day off from work and attend a court date, JUST BECAUSE ASSHAT'S LAWYER DOESN"T THINK THAT REPAIRS SHOULD AMOUNT UP TO $2221.xx!!!!

I wish I had gone to the dealer to get the estimate too, but they charge $75 for a repair estimate.  But you sure as f%$k know that the estimate wouldn't have been a measley $2221.xx.  It would be closer to $3000 including labor to straighten the subframe and all the little nitty gritty parts (screws, nuts, bolts, etc.)

DEATH TO ALL LAWYERS!!!  (not the one's who ride tho. :laugh:)

Did you speak to the judge?  He's the at-fault in this situation...the judge would have listened to you about how taking off work is costing you money and placing tension between you and your boss.  You could have forced the issue right there.  And if the guy who actually hit you didn't show up, you probably could have walked out of there with legal ownership of the man's soul.

An, you need to get a lawyer and sue the guy for lost wages attending court (daily salary X however many days off) and the legal costs.  A lawyer would have settled this for you long time ago.  I don't think you would have had any difficulty finding a pro-bono attourney to kick their asses.

As of right now, it's still just Commonwealth vs. Asshat.

I have yet to be involved directly.  All I have been doing is basically attending HIS court date to see what's going on.  IF I can't get full restitution from the process, I'll definitely hire a lawyer and get it that way.

I would, at the very least, consult with a lawyer. Pro-bono or not. Preferably a motorcycle lawyer.

I hate people who sue for no reason, But you have reason. If I were sue I'd sue the living shaZam! outta this guy.

3imo - I definitely am not the type to go sue-happy, but I will sue to get what I rightfully deserve.  And what I rightfully deserve is to get full restitution.  If it goes that far, I'm bringing the GS to a dealer...  They cam get me a FULL quote, including the labor and costs to straighten the subframe.  You bet your ass it'll be much more than $2221.xx.  And the lawyer and court costs that I incur.

Arent you covered for uninsured motorists? If so, your company will pay you after an estimate and pursue payment on their own.

If not: err on the side of heavy-handedness for now, the hit and run dooshbag has a lawyer who will err on the side of leniency for him.

At least talk with a lawyer and set up a meeting with one you think is good. Set a meeting, don't necessarily sign anything, but weigh options. You can use the threat of legal action to get your proper restitution. If the threat doesn't work and your case is strong, as it seems to be, sue. Go for the neck. For the full amount. More than a little for pain and suffering.

He struck you from behind, ran from the scene and eluded you? He deserved to be dragged from his car and beaten, and have his car driven off a cliff, not to mention paying you everything he did to you.

75 is worth having an estimate to show. I'd do it.

I do not have collision.  Otherwise, my insurance company would have paid me directly and gone after asshat for the money.

I'm wondering if there's a seperate section that covers uninsured motorists hitting me...  hmmm.

If so, I'm gonna be PISSED.  My agent told me that since I don't have collision, they can't help me, and I'd have to get the money on my own.

But since then, I've changed insurance companies...  I would still have a case against my old agent, right?

It depends on the state laws. NY requires you to have Uninsured/under-insured even if you don't have collision. Read your policy, see what you bought.

I checked my old coverage statement from the old agent...

I *DID* have coverage against uninsured/underinsured motorist, but only for bodily injury, not personal property that I own.

Oh well.  Let's see what happens on April 3rd.
