Wife went down:GS may be dead ?!

Well today I got a shock...About 10 am I get a phone call from my wife.  Didn't think anything of it.  She sometimes calls when she gets to work to remind me of somthing (typical husband, forgets everything ;)   Well she tells me that she got clipped by a guy in a cage and that she is ok. :o

I rush out to get her and she is really ok.  Just a bruised foot cause she wore sneakers intead of boots. :?  
What happend was that the guy in the car was turning left into the Starbuck's and was going to cross several lanes.  Traffic was backed up on the right two lanes and the third was still moving in the direction my wife was traveling.  Right two lanes stopped to let the car through (since they were stopped anyway) but the third lane kept going.  Anyway, the car just clipped the back of the bike and spun her off and sent the bike sailing toward a fire hydrant.  She slid mostly on her back and the bike just stopped in front of the hydrant.

I'm thankful the guy totally claimed responsibility and didn't bolt like I have read on the board and the one I saw this past weekend.  I know I am rambling but it does feel a bit better that I get this out.  I am actually more shaken up than she is :oops:  

Bike is thrashed though.  Handelbar, mirrors, bar ends, centerstand, exhaust...just to name a few.  I have a feeling that the frame is just off too.  If it is I just may toatal it and use the money to get her something better :)

Well thanks for lettin me babble a bit.  I know I don't post often but I do feel a bit better.

Glad and releived that your wife is allright! Bikes can be replaced. Also, glad the guy copped to it, instead of denying it. Honest person. Hope everything works out for you.

Damn! I'm so glad she's okay. That's rotten about the bike, but bikes are replaceable. I hope your wife doesn't get put off by riding.

Glad that she and you are both okay, and nothing major was damaged.  Like everyone said, the GS could be replaced, perhaps by a bigger bike.

I almost had the similar experience two weekends ago in the local area.  I was almost ready to take a hit, but the car stopped in time.  And at the moment the first thought is I am glad that I have my jacket on.

I am glad she isnt that badly hurt, and the bike has taken more damage than her. Like others have said teh bike can be replaced. The damage doesnt seem to be much, if there is frame damage, yeah that would have to be replaced, but you know what that bike is probably get totalled. Dealers like to replace parts even with teh smallest scratch so they can make some extra money and with teh GS base price being so low I am sure they will can it.. Which means your wife can get something else..

Hope she gets better soon. It sorta sucks that she crashed but I am glad she is unhurt.

The bike is probably an insurance total. Another GS race bike has been born!

Have the wife go see a doc. Even if she says she's fine and its only a bruise, lower legs are very delicate and ligiment damage may not show up until later when the brusing pain and swelling go down.

Also going to a doc immediately after will start the paper trail you need if she does need work done and you want to make an injury claim against the other guys insurance.

Oooo That sounds painful...but glad it wasn't worse...So here's what you do...Go to doctors...cost is no object, got to the chiropractor once again cost no object, massage therapist and once again $$$ no object, and sue sue sue...Better than new is the goal here both for her and the bike. Of course you need time off (well she does to rest that foot/leg/hip/whole one side of the body and ofcourse the other side is permamently attached so its gotta rest too...) and the insurance company will pick up the tab as lost wages. All that is the actuals, of course there is the biggie - pain and suffering...

BTW the bike...if they total it and opt to replace it...you can keep it giving up 10%(15% if newer than 10 yrs) of the amount they offer. That means you can actually fix it for less than replacement if damage is not severe.

It sounds scary!  Yeah- please have her see a doc.  It can't hurt and it is a good thing to have a paper trail if one is needed.  Hopefully she won't need it!  Best to be safe!

Maybe I'm misunderstanding the intent here...but it sounds like this is advising to submit exaggerated and fictitious claims, which would  fraudulent, dishonest, and criminal.  I'm sure I've got something wrong.

I think what srinath was trying to say is not to compromise with your medical care and recovery of lost assets.  If the guy was not driving alertly and was at fault, then the burden of 'undoing' the accident is all his.  

that being said, get better, get the bike replaced, and try not to be too opportunistic beyond that... that's what's wrong with our legal system today: "pain and suffering" and "punitive damages" tip the balance in the favor of the plaintiff.  If he screwed up, make him fix it, but "punitive damages" and "revenge" are dangerously close to being synonyms in our legal system.

also keep this in mind... they guy's insurance will run out sooner or later... in my state, the minimums are only about 10grand in personal injury per accident!

I said better than new...You may have had foot pain before or ankle pain before...They have no way to cure your new ankle pain and leave the old pain as is...Your bike may have has a scratch in the tail before...now its broken in 4...no way to fix the breaks and leave the scratch intact...Better than new did not mean better than when it rolled into the showroom floor...that in reality is impossible...Fixing accident damage is very objective...if it shows any sign of damage they replace it. They dont care that a scratch was there earlier in a broken panel. Pain and suffering is there just to turn the incident into the victims favor...the rest will leave the victim in theory a few seconds before the incident. Re write the laws if you dont want victims to get out even or ahead.

Glad da' lady is okay.  

As fer the bike, sounds like most of the broken bits are the kind of stuff that is common on EBAY.  You could buy the thing back from the insurance co and put it back together for very little $$.  If you wanted.  OR maybe it is time you went racing.... :thumb:
