What do you think of the judicial system?

It's been slow lately so here is another "pot stirrer".

What do you think about lawyers who lie, cheat, and steal to get a client off?

How about judges who declare what Congress passes to be "unconstitutional"?

How about "three strikes" laws?

What about capital punishment?

Or, laws and regulations so complicated the ONLY way through it is with a lawyer.  Why is this so?

Oh, there's more, this should get a few of you talking...

1. They are criminals.  The law protects lawyers from having to implicate their own clients, so saying 'he didn't do it' when he really did DOES NOT constitute cheating.  Lawyers must follow a strict code of ethics.  They must also aggressively represent the interests of their client within that ethical framework... a slippery slope.  This is why I will never be a defense lawyer.

2. Unconstitutional laws are passed all the time (just read the second amendment).  Judges are there to interpret the law.  I consider this an interpretation.  Somebody has to keep congress 'honest'.  I see where you might be going with this and I do get sick when judges or juries ignore the law and rule based on personal opinion.

3. three strikes laws kick butt.  I can see giving someone the benefit of the doubt once or even twice.. after all, innocent people are convicted all the time.  Our system of justice might fail now and then, but three times in a row... nope.

4. Capital punishment is appropriate in the most sick and depraved crimes.  Even then, the jerk sits on death row for 20 years.. not exactly swift justice, is it?

5. Because lawyers and politicians are all part of the same gang.  In fact many politicians are or were lawyers at one time and vice versa.  Its a big racket.  Also, complex law is part of our societal fabric now.  Think about it.  As an example: if we threw out all the complicated tax law in this country and had a flat-tax, how many tax-preparers, IRS employees and accountants would lose their jobs?  Unemployment would reach an all time high.

I'm getting bored with the ghey thread so I figured I'd come over here again...

Oh, how right you are!  But...

1.  Was the intent of the founders to try to get a guilty person off the hook at any cost?  I think they meant a "fair" trial so people weren't railroaded.  To do WHATEVER it takes including smearing innocent witnesses is criminal in itself.  What's the saying...  Innocent until proven poor.  If you've got the cash you can beat anything, unless all of Congress is out to get you.  Sorry Martha, if you had killed someone you probably would have beaten the wrap.

2.  Agreed.  Law/Society is constantly evolving.  But, putting "rights" where there are none or none were intended does bother me.  Everyone can't have the right to do anything they want.  It kills me how there are professional "court shoppers" who's only mission in life is to keep track of which courts/judges will most likely rule in your favor.  Just goes to show how inperfect the system is.

3.  Totally agree.

4.  Again, agree.  2 maybe 3 appeals and that's it.  What is it, up to 10 now?  Like this guy in Atlanta who shot all those people in the courtroom.  What trial?  They should just have a rope set up in there and hang him on the spot.  There is NO doubt he is guilty.

5.  Again I agree, but isn't that just "wasted" money.  There is NO production of wealth in any of these jobs.  It's like security, you pay and get nothing back.  They all just drain money from actual producers.  Re-divert them to something more "meaningful".  Slowly weed out the "leech" professions.

I'd like to discuss the flaws in our two party system.  Look at how Congress deadlocks on such pitiful things.  Party, party, party, that is ALL they care about.  Don't pass the EXACT same legislation we floored last term because this time the other party is proposing it.  It kills me.

Look at the hoops a third party or independent candidate must jump through to get on the ballot.  Whereas all the Dems/Republicans have to do is pretty much submit a name.  Whomever they think they can control best and has a decent chance of winning.  We vote for people we have NO clue to what they are like, believe in, anything about them.

Thank God they're all successful businessmen.  I don't think they'll do TOO MUCH to effect the economy because that would cut their profits.  And in reality, the economy is all that matters.

three strikes laws don't seem to have worked out from what i've seen.

here in CA, they've resulted in 4200 people serving life for such crimes as shoplifting, receiving stolen goods, and drug possession.

if the three strikes law were amended (as has been proposed) to only apply to violent crimes, then i say hell yes.

and yeah, the two party lock on this country is BS.  in many locales, the green party has successfully petitioned for Instant Runoff Voting, a system which i believe would greatly help break the deadlock.

you should see if there's any such movement in your area.  you don't have to agree with the greens at all, but i think that on this particular issue they're very much correct.
