Gardener Ordered to Remove Barbed Wire Fence on Grounds It Could 'Wound Thieves'

A British gardener's local council has ordered him to remove a 3-foot high barbed wire fence around his property in case thieves hurt themselves on it, the Daily Mail reported Thursday.

Bill Malcolm, 61, installed the wire at his Worcester property after burglars robbed his tool shed and vegetable plots three times in four months, stealing more than $500 worth of hardware.

But Malcolm's local council told him the wire was a health and safety hazard and warned him they would remove it by force if he did not do it himself, the Mail reported.

"The council said they were unhappy about the precautions I had made but my response was to tell them that only someone climbing over on to my allotment could possibly hurt themselves," Malcolm told the Mail. "They shouldn't be trespassing in the first place but the council apologized and said they didn't want to be sued by a wounded thief."

The council said that a fence on the property must be a post or rail fence, not barbed wire.

"With regard to the barbed wire, when this is identified on site, we are obliged to request its removal or remove it on health and safety grounds to the general public as this is a liability issue," a council spokeswoman told the Mail.

Hate to tell you this, Yama, but the ACLU in this case would probably argue on the side of the property owner. 

The ACLU is a popular target for the right because the organization believes in the constitution, not in merging state and church, but they argue on the side of constitutionally guaranteed liberties in all cases.  It's not a "liberal" organization.  It's a liberties organization.

I'm proud to say I have been an ACLU member since 1992.

Where does the ACLU get it's funding? Were any of it's founding members Communists? Are any of the leadership members of CPUSA?
In it's hierarchy, I'd like for you to tell me it's Jewish kinship especially in the upper eschelon. Aren't they anti-Christian? I don't want to hear about how they represented the nazi party and the kkk once upon a time. I want to hear about their "agenda".
They need to be run out of this country on a damn flat car straight into hell.

The ACLU gets its funding from its members and their contributions.  It gets lots of legal work done pro bono.

I could care less if its founders were in the Communist Party (or accused of it) at one time.  It's not illegal to be a member of a political party in this country.  I am positive some of the members and founders were Jewish.  That, also, is not illegal.  I am proud to be associated with them.

IMHO, I think Anyone caught in the act of a crime that "just so happens" to get injured while doing so shouldnt have the ability to sue anyone for the injuries they incured whilst comitting the criminal act. A person protecting thier property that they pay for, should have the right to do so with passive means such as a barbed wire fence.  I side with the property owner on this one.  No one has any business climbing the fence, so if they get hurt, thier bad, no rights when youre stupid. THats how the human race is going to die off, protecting the stupid and those who mean harm against other humans.

Back on topic...........Castle Doctrine often applies to any structure on ones property.  Ergo, if the mother fucker came back I'd blow his f%$king kneecaps off and piss on his face while waiting for the ambulance.................but I'm lucky enough to live in a state where a proper law-abiding citizen is allowed to defend themself and their property.
