another ticket....please help me....

i got pulled over for lane-splitting today.......im so sad........
i dont wanna sound like the typical 20 yr old male but i really dont need any more points on my license.  i got 9 points last april or may for speeding and "lane changing". i wouldve fought the lane changing but i didnt have access to a car to take to me court in albany....then a few weeks ago i got a bogus ticket that says 58 in a 30 but in reality i was going like 42 so ill plead guilty to a lesser degree....another 3 points if i get lesser degree......another 6 if i dont.  so the total is at 12 or 15.  lane splitting would be another 3 im guessing....so it goes to 15 or 18. i think msf knocks off 2 so ill have 13 or 16...from what ive heard, license is taken away at 13 points.....and points dont count after 18 months? i can try to stall the court dates until november so the first 9 points go away...and then i can take defensive driving to lower the remaining 6 to 2 points.  if i cant stall ill have to take defensive driving now and lower the first 9 points to 5 so i have room for the other points to stack on.....
so the question is.....do i wait for the first 9 points to die out? and save the defensive driving for the newer points? or do i play it safe and take defensive driving for the first 9 points? or should i just get my license taken away?  do all the points go away when i get my license back?

oh yea...for the lane splitting, the cop didnt ask me for my registration, just my license....so on the ticket some info about the vehicle is all wrong....BUT! i dont think i can use that b/c since i bought the bike towards the end of the summer, i didnt think i should waste money on insurance this year bc id store it anyway....so its not registered or insured under my name......is there anyway i can point out the wrong info to the judge w/o bringing attention to (getting in trouble for) my lack of registration/insurance??

If any info is wrong, the ticket is waived.. NO MATTER WHAT. They cant re-cite you for insurance etc.. but i wouldnt ride to the court..lol

If they keep a prisoner longer than a certain amount of allotted time before he is convicted or sent to trial.. (for something kinda minor) he goes free. Regardless of anything. Hes free... its unconstitutional to do otherwise..

so what do i do? mail the ticket back and plead not guilty? and then point it out during the hearing?  do i have to contact previous owner for his regstration and show that in court to prove it?

You wont have to worry yourself with this stuff if you just do what you know you should. Don't drive like a moron. Hey, man..if you're from queens, why is the court in Albany?
Do you go to school there..or were you on the Thruway/Northway?

Regradless, I'd have to agree with antibody.  Think of this as a "rite of passage"...you're becoming a man.

Try the loopholes (as attorney Rashad suggests) it may actually work; take the driving course NOW...and just be careful.  I'm sure you're a good guy, just as you said typically 20...hope you'll be around riding a long time. (PS I'm up in the Trilakes..Placid/Saranac).  Good luck.

Why don't you talk to an attorney?!  I'm sure any advice people on the board can give won't be 100% accurate, even though some of us may stay at a Holiday Inn Express on occasion. ;)

A few months ago I purchased a sort legal insurance that covers any traffic violation. I call the law firm and fax them the ticket, and they go to court with me if it's local, and for me if it's not.

I don't drive like a maniac (just really fast when I can get away with it), and haven't had to use it yet, but this coverage area of the policy is awesome. I've only ever had one speeding ticket, and it was dropped. I know several other people who do drive like freaks, and one, after literally 5 tickets in two years, has no points on record and paid less than $160 in fines. You seriously ought to check it out.

Drive fast and have fun, but if you run over a little kid, I'll kick your ***    :nono:

Not to be an ass, but my suggestion is to stop breaking so many laws.  We pretty much all speed, and pretty often, but get that stuff in check.  At this rate, you won't have to worry about it because you won't have a license.

Dude no advice really...except dont split lanes where its illegal...I hate this place but I dont split...good thing traffic isn't that bad mostly, I have  points and have received a lot of them...but never so many in so short a time...I'd move to a different state (just in name) where they dont have a points transfer with your state, Check CA...they now have opened up their licensing laws so anyone from anywhere can get a licence...so make use of it before the completely incumbent Davis is terminated...or short changed...or smashed like a watermelon...or is busted...

i know this is crappy advice, but if you choose to break the law i.e. lane splitting, speeding, etc.etc.etc. dont do it within sight of the police. :nono: most of us, usually will stretch, break, snap a law here and there. if you choose to do that, BE VERY VERY CAREFUL, take the driving class as a pre-emptive measure. it may help. also look into what rashad was sayin. :nono:  :thumb:

that's not true.  getting things wrong like spelling mistakes, or model years, saying a car is tan instead of champagne, etc., etc. is not enough to get you out of a ticket.

It is if you go to court and tell them that isnt your car on the ticket, or if they write a ticket that should go to the vehicle owner (ie broken headlight, unsigned registration) and they write your name as the offender. I got out of a bogus unsigned registration ticket because of that!

First of all, it's unlikely the wrong info on the ticket is going to get you out of anything. I tried that defense once and all it did was piss off the judge. In my experience (and unfortunately, I have lots of it - in my younger years of course) it's better to be honest and respectful - that will go a lot farther with the judge and officer. Since sentencing is largely at the judges discretion, if you can't afford an attorney, being respectful to the judge and court is the next best thing you can do. If you take the defensive driving course on your own before court, most judges will take that as an act of good faith and go a little easier on you. I'm not sure about NY, but in Virginia the course is $60 if you sign up voluntarily and $180 if it's court ordered - so there's a little extra incentive to sign up.

Dress nice, answer "yes sir" or "yes ma'am" when the judge or officer addresses you, and hope the judge got a little lovin' before work in the morning. Godspeed my friend.

i kno ive been stupid.......and i dont plan on fighting the lanesplitting at all bc it WAS totally my fault....the 58 in a 30 zone is totally bogus tho....i plan on pleading guilty to a lesser degree (if it exists?)

I think point reduction in NY eliminates points, not offenses, therefore as the time limit passes for offenses, your points will drop further.  But, you have to specify on your MSF or defensive driving if you are using it towards point reduction at the time of the class.

Be a good rider/driver.  Don't let the state take away your toys!  (well, the license to use them anyways)

And whoever in the Meet and Greet section that said nobody cares if you split lanes in NYC...  :roll:

It will cost you all of about $10.00 at most to fix your current problem.
