No need to discuss the speed..this is a public forum.. however on the ticket here in WA  the officer put down  model GS550/L  on my registration it clearly states GS500  is that winnable in court?  I would say the officer stopped the wrong bike.. it wasnt me she radared.

Interesting the the officer even thought to write down a model that actually existed.  I should critique her error in that the GS550L is an inline four, but she probably didn't count the headers.  Bring pictures of that model and yours to court to contest it.

I tried to fight a ticket I got on my GS... There was an error on my ticket as well... Judge said "Officers make that mistake all the time"

Yea, I'd call boobies on that one as my defence, unless the boobies are present in court its yours baby, I would want to see the evidence obviously.

I have had tons and tons of traffic tickets.  Your'e not gonna get off that easy, no way.  That's a minor technicality; the judge isn't gonna care...

I tried to fight a ticket once, got no where, but I think when you walk in with a 65 in a 25 ticket, the judge has already made up his mind, even if the cop was a royal jackass. I guarantee you that cop or the judge would've done that same EXACT thing if he had 100hp and a car full of girls next to him!

Your technicality probably wouldn't get you anywhere. 

I had one: traveling 65-70 in a 55.  Super Trooper coming toward me sees the nose of my car dip.  My Valentine 1 is still silent.  He turns around stops me, and tells me he clocked me at 75.  I ask to see the radar unit.  He says, "Sure".  It's blank.  I said, "your radar doesn't say 75." 

"I can testify in any court in this State that you were going 75,"  says the prick.  He failed to check any box on the ticket indicating the method of speed detection.  I thought I had a case.

Guess what?  He "testified" that his radar sounded a high tone and that it read 75.  I testified that he couldn't have used radar or any other means to detect my speed because I wasn't going that fast, and he himself didn't indicate a method of detection.

Judge said the omission was just a mistake and believed the lying sack in uniform.

Oh, by the way, in many municipalities, a portion of your traffic fine goes to enforcement officers' retirement funds.

Honestly, what is really ticking me off in Central Florida right now is as of July 1,2009 no seat belt is a primary offense. Meaning they can pull you over just for the seat belt. Well, okay not entirely mad about that. My first upset with the law happened on July 1 there was a large sign on John Young Parkway a busy six lane road three lanes in opposite directions. Well, there was two cops standing at the sign informing people of the new seatbelt law as peope were buckling up they were pulling them over. Okay not really upset at this point then I slam on my brakes. Why, an officer was walking WALKING a car against three lanes of traffic to give him the ticket almost creating a wreck. So, how is that safe thinking to my self. Then I look ahead of the driver being pulled over (single person in car) a minivan with four kids running around! WTF the soccer mom in the Minivan with Four Violations talking on the cell phone didn't get pulled over. I mean seriously who is putting who in danger? The guy in the car seeing the sign trying to put his seat belt on when he saw the sign or the Soccer mom who was completely oblivious to the sign putting four lives in danger!

I'm sorry that is not putting "safety" first that is just generating revenue! Today cops were standing in at least four intersections ticketing people without seatbelts! While the intersection at my house that is underconstruction has become dangerous for anyone trying to get out. I spoke with a KPD officer that was out at our apartment bike registration event about the intersection and said that since construction began there two weeks ago there has been at least three accidents there a day!

I'm sorry but I'm just disgusted with some of this stuff!

In New Jersey we have had the seatbelt as a primary offense for a while along with talking on the cell phone.  That doesn't really bother me as i always wear my seatbelt and have bluetooth in my car but i had picked up my phone from my pocket one day to work and got pulled over for having my cell phone in my hand.  Cop was nice enough to let me off with a warning since i would have been able to prove in court with a cell phone record that i hadn't made any call.  What really bothers me is when you see people flying down the highway on phones past cops and the cops don't even think about pulling the people over.

As of July 6th here what really annoys me is they raised the price to register a motorcycle from $31.50 a year to $65 and my registration needed to be renewed this month.  I had the paper for renewal last month but just decided to wait since it had the 31.50 on it and wasn't up until the end of the month.  Then they sent a new one July 1st saying it would go up to $65 unless i paid by the 6th but they closed the dmv's and their website was under maintenance until the 6th.

i stopped getting tickets a long time ago, slow it down, or speed it up, or do both. thats what i do now, commute like on on a stroll, and race on something made for racing when the need strikes.

you'll lose the fight.  small technicalities is what tv law shows are made out of.  very rarely does it happen in real life.

the only time i've "won" a DUI case where I should've lost is when the probable cause cop didn't show, but the cop that ran the DUI test did.  No probably cause, the evidence got tossed.  End of story.

if you go to court, and the cop doesn't show, you win.  :)  that's about it.... speeding is speeding and the judge will ask you under oath if you were speeding.  if you say "i was doing 46 maybe (in a 45) but i wasn't doing 70"  tough crapola..  You're speeding.  never admit to going over.  You were going exactly the speed limit.  there must be an error in your speedometer but you didn't weren't speeding according to your instrumentation.

One of my good friends got his ticket dismissed because his last name was spelled incorrectly on the ticket.

His last name is wells and the officer wrote walls.  :bs:

After the judge throws the book at you ... you can ask for "a wise latina woman" ... and say that you want a better conclusion that only she would reach.

When it comes to Cops word vs Your word, judge takes cops word. You lose.

When it comes to Faulty instrumentation - gauge said 55 but real speed was 60, for example - you were still Actually speeding. You lose. (In Australia)

It costs you time off work ($$$) and or other $$$ to fight the ticket. You lose even if you win.

If you agree to tell the Truth you can only tell YOUR truth. Court sees differently. You lose.

By turning up to answer the case you admit it is Your case to answer to (you would never attend a case that wasn't yours would you?). Your agreement of Understanding is an agreement to Stand Under their authority. A Summons is only an Invitation but your acceptance of it indicates guilt. You lose.

ALL courts are actually private corporations designed to make $$$. You lose.

Onward...

If you choose to fight then have your speedo calibrated/tested to make sure. The calibration/test print out is your Proof but costs YOU $$$. (Even if you win it costs you money.)

Never swear to tell the truth.

Never admit to Understanding as it signifies your agreement to stand under - and they need your agreement.

Learn their Legalese - words may be the same as English but have different meanings and your ignorance will trap you in their jurisdiction and verdict (law dictionaries help here - there are free ones online). And it's ALL about jurisdiction and your willing subjugation to their jurisdiction. They are skilled at getting you to willingly enter their jurisdiction and to subjugate yourself to their Punishment for something that caused no harm or loss.

I am not a lawyer or attorney nor do I practice one on TV or on forums. Google the above points - may need to look at Freedom sites to find indepth answers - because if you choose to enter their word you need to come prepared, they do this for a living.
