Lost my job.....

Well, I got hurt at work. At first it was minor discomfort in my left forearm where the tendons that control my left hand are located. I didn't tell my "group leader" because I did not feel that this was serious. WELL, the next week, I started hurting BADLY 35 minutes before end of shift, so I figured I would see the on-site nurse the next day, which I did. Now, because I did not tell my group leader the instant I felt pain, they let me go because they have a very serious policy to report ALL incidents as soon as they happen. I didn't feel like this was an incident at first. I thought it was part of the job to during the first few weeks to feel that. Oh well, I believe that life is a Buddha Loves You and then you die. And God, if you read this, I am STILL waiting on the dying part.....

Sorry to hear about the job loss, but you're still young and you still have plenty of life to live.  Is it legal for them to fire you because you were hurt at work?

They didn't fire him for getting hurt, they fired him for violating a policy.  That's the trend these days.

I'm kinda scared about the same thing right now.   I slipped and fell at work 10 days ago.  I did tell my immediate supervisor about it within 60 seconds, but we did not fill out a written report, as I felt fine, other than superficial skin damage.   Well, I can tell you now that my back feels odd in 2 places, and I know there is something wrong.   But I'm afraid to go back and fill out a written report now, as I may lose my job, but if I don't fill out a written report, Workman's Comp won't touch it.   So I have to decide which road to take...
On those days when life is a little too much and nothing seems to be going right, I pause for a moment to ponder the wise last words of my grandfather:  "I wonder where the mother bear is?"

I'm by no means an expert and am just sharing my experiences so don't hold me liable if something happins.  But please take this seriously. 

I'd fill out the report first thing in the morning.  You're not alone in this.  Your supervisor's a$$ is on the line just as much as yours.  He or she knows the rules.  You followed the rules by reporting it.  It shouldn't matter if you thought you "felt fine" and didn't need to do paperwork.  Your supervisor gets paid to make decisions like that, not you.  If it makes you feel better, call a workman's comp lawyer first thing in the morning.  (Phone call is free)  There is no law against being well prepared.  

GET IT ON PAPER EVERY TIME.  IT'S COVERED MY REAR TWICE ALREADY!!!   I nearly ended my career with a bad shoulder injury (lot of rehab but fortunately back to 100%+).  You'll be amazed what sorts of trickery your employer will have up their sleeve.

I understand that, but if the affects from the injury were not noticed until a week later, then how is he supposed to know whether it was serious or not.  I know if I had an accident and I didn't feel much pain then I wouldn't feel I need to report it.  Anyways, that's b/s.

That's why you have to get it in writing every time...because noone knows what is going to hurt later and what won't.  

Workman's comp is run by the state, not your employer.  The state has a list of requirements that need to be met to be eligable.  This includes reporting and seeking medical attention within a certain number of days.  Miss anything and the state disqualifies you.  Then your only option is to go after the company.  Who do you think can afford better lawyers?

Yea I got fired too, then unemployment got refused cos the Old a$$holes said severance in the letter they fired me ... but they didn't pay me no severance ... so no unemployment either. I have to take em to court or I dont get squat. I suspect they will declare bankruptcy if I do take em to court.

So yea good luck there kiddo, a$$holes, the lot of them ... and those that are working, remember to steal sheite as and when you can.
Now Who wants to buy a stapler. Almost no use, how about a 1/2 used roll of tape with dispenser that only rolls at the right angle.

Thanks everyone.....  Caffeine, GO FILL OUT THE PAPERWORK!!!!!  YOU ONLY HAVE 14 DAYS AFTER THE DATE OF THE INCIDENT TO GET WORKMAN'S COMP!!!!!  You only got four days left as of the time of your writting.  Just get some witnesses who know you talked to the superviser that day so you don't get f%&ked by company policy.  Good luck!

I'll just say again what I said above:  The trend nowadays with most companies is to "fire" you for a policy violation.  No unemployment coverage because you allegedly were fired because of your own actions.  It's sneaky, but effective.  My previous company had so many rules and regulations, but they would TELL you to do things that were the opposite of what the written policy was, that way when they wanted to get rid of you, they would sneak in, get you violating a written policy...GONE.   No unemployment coverage for you, because you violated a written policy.   End of story.  They would just deny that they said to do anything different from the written policy.

None of the lawyers I am calling will do free nothing. I guess they are swamped ... I only got free 2 second advice from a neighbor/friend/biker/doctor's lawyer.
Really, if I wasn't working on his bike - and was I very reluctant to do that and my wife hated him till he gave me a lawyer reference who did talk to me, I'd have had no legal advice.

I  know that the term 'socialism' seems to be regarded as a dirty word in the USA and I understand from news reports we receive from this side of the pond that it is used as an insult in relation to President Obama and his health reforms.  But socialism, as I understand it and grew up with, is about the rights of the working man (it has nothing to do with communism).  I'm absolutely horrified at the treatment you received, dafatrman.  Employers here have a legal duty of care to their employees, and would be in deep do-do if they treated their employees like you have been treated.

I hope you find another job soon and then you can stick two fingers up at them :thumb:

Just for the avoidance of doubt - don't believe the crap your media (and certain UK cretinous Members of Parliament) might spout and spin about the UK National Health Service - it's wonderful and I got the best care anyone could expect when i had my heart attack 5 years ago.  We all pay for it through our taxes - which is a damn sight cheaper than private medical insurance and bills (sorry to highjack the posting).  Everyone gets equal treatment irrespective of race or social class.

Their version is what FOX news says it is that day....Anything anti-corporation or pro-environment gets labeled 'Socialism'.
Unions are 'Socialist', etc, etc... Im an actual American Socialist. I vote straight Socialist on any national issue or election.
Whats crazy here are a lot of the ppl who are the biggest haters of Socialism are the ones who could benefit from it the most.
