On Sunday evening BaltimoreGS and I took a ride to Pennsylvania and as we were heading home a van pulled out from a private drive and hit me.  I  was wondering if his insurance could possibly buy me a new helmet since I hit my head pretty hard.

I'm glad to see you are alright.  How's the bike?  And yes his insurance should cover the cost of a new helmet if the impact was a part of the accident.  Do you have a spare helmet?  If not, what size do you wear?  You can use my spare until you get a new one.

Down here, Helmet Replacement is usually part of our insurance. So if someone hits you, you get the bike fixed and a new helmet from Your insurance company and They chase up the $$$ from the other guy.

In short, Yes, you should be able to get a new helmet.

police report, police report, police report. Did you file a police report? His insurance should cover everything. Any helmet mfg will tell you not to use their helmet after an accident.

The one way they might try to bend you over is demanding a receipt for the helmet, but then I do live in BC (we have a provincial insurance company) so you might not have that issue

The thing I'm worried about most is that I was not riding my bike at the time b/c mine is broken down.  I don't want the owner of the bike that I was riding to have an increase in insurance because some idiot hit me.  I am also not on his insurance policy.  And yes, a police report was filed.

The bike is in ride-able condition, but the right clip-on is bent badly and the mirrors are broken.  There was a little scuffing to the paint, but it should be able to buff out.

@Porkchop:  I wear a small, but it varies between helmet manufacturers.  Thanks for the offer, but I honestly don't see myself doing much riding for the next couple months.  It's not because I'm afraid either, but because I no longer have a bike to ride (read: mine's junk and not ride-able) and I don't want to screw up someone else's bike.  To be honest, and this might sound a little sadistic, but getting into an accident is an adrenaline rush....kind of like a high.  I'm very glad that I've been able to walk away from both accidents that I have been involved in.  :thumb:

You were riding passenger?

If so, his insurance covers you as a passenger. but since the van pulled out and hit you.... its the van fault by the sounds of it so their insurance should pay. (in Ontario anyways)

As far as who's rate will go up... guess.

In Canada... if I was parked and someone hit me my rates and their rates would go up. Mine for as little as 5 years and theirs may never drop. Its garbage.

I pay $741.00 with StateFarm for my 07 GS. (over 25) We should start an insurance thread.

No, I was the driver.  I was driving my friend's motorcycle.

As far as this situation goes, his insurance company doesn't need to be involved at all. I wouldn't even call them because they'll take any chance they can get to increase your rates. If he hit you just call his insurance company directly. It shouldn't matter who's bike you were on, his insurance would be responsible whether you were on your motorcycle, a bicycle, or walking and carrying your helmet under your arm. It's not like he can just run over a pedestrain and say "you weren't in a car so I'm not paying for it". His insurance should take care of your friends bike as well.

That's what I'm hearing from a lot of people, but the owner of the bike is worried his rates will increase too.  And I don't want his rates to increase because then I'd feel like an ass.

I think some insurance companies really don't want to cover motorcycles, so they have a stupid high premium. I have found progressive to be the best for me, and they have up to $3,000 accessory insurance for after market stuff and what ever gear your wearing thrown in for free. Just keep your receipts!
