Don't beat yourself up too bad. Crap happens.  I suggest you go the official route with having your neighbor file a claim on your insurance.   Your rates may go up, but not dealing with the headaches of pissed off neighbors and getting them paid will be worth it IMO.  Lauren's own liability insurance (assuming she has a car?) may even cover it.

Well just talked to the neighbor girl (the car who was it) and she said she got two estimates from two different places today.... one for 1750 and one for 1800  :sad:. I was shocked.... that beretta is probably only worth a few hundred buck more than that! Granted its in pristine condition (read: no rust) and it the sporty "z26" model, but its a freakin' 17 year old car. I called Lauren and told her the estimate and she started bawling her eyes out. An hour later she calls back and asks if we can go through my insurance for the accident, and that she already talked to her insurance agent and her auto policy will not cover the motorcycle accident even though she was licensed to ride a motorcycle. She said she would pay the deductible and the increase in my rates. I really do not want to go this route and feel I'm being nice enough by not making her buy the bike off me under the "you break it, you buy it" policy, then again I don't want her to pay my neighbor 1800 bucks and have him put a new mirror on and fix the scratches with a $6 bottle of touch up paint and pocket the rest. Any advice? I still need to take photos.

This is a sticky situation.

If Lauren has a motorcycle license or permit then: file claim with your insurance.  I know you said she passed an MSF course, but you didn't say if she got lic or permit.  This limits your liability to probably $500 -and if she decides to sue you for injury you are covered. (she can sue you claiming your bike was unsafe whether it is true or not)

If Lauren does not have a lic or permit: Pray Lauren pays for damage, or more likely YOU will be paying for the damage.  Pray she does not sue you for injury.

This is the exact reason people do not allow test rides before purchase.  It seems to happen far too often.  It's like Murphy is waiting down the street just waiting to apply his law.

Truth is.  Be prepared to get screwed.  Accept this fact.  Be prepared to have your friendship/acquaintance end fairly quickly.  She already knows you are on the hook ultimately.  It will probably go like this:  I don't want the bike after all (already done). Then... I really don't have the money to pay for your bike, but I will eventually.  Then...I promise to pay your neighbor for the damage eventually.  Then... Neighbors sue YOU in small claims court.  Then...You never hear from Lauren, when you call she lets it go to VM.  Then... You and up paying for it all yourself.

Bringing insurance into this will dramatically reduce the ass raping you will get.

Please follow this saga up.  I want to see how close I am to how things play out.

Yeah, thanks John for your comment, very helpful. Yes, she has her actual motorcycle endorsement on her license, it was put on about an hour before she test rode the bike, but if a claim is made on my insurance even if I wasn't driving, wouldn't my rates go up? Her auto insurance won't cover the damage because she was on a motorcycle.

Forget about what *might* happen to your insurance rates.  You did not get into the accident, she did.  Tell the ins co the truth, and start the ball rolling. 

I was teaching somebody how to drive and got into an accident.  My rates did not go up.  Rates are often determined by a point system.  Accident = 3 or 5, DUI = 7 or whatever, speeding ticket =1.  You were not driving.  You were not driving.  You were NOT driving.

Just make the call.  Give the agent all the info and move on.  Waiting will not help you.  Do it now.  You paid for their protection and services.  Use them.  The worst they can say is you are on your own -which they will not.

+1 !! ... even 'if' the rates went up .. doubt its going to be costing you/her the same amount as paying the repair yourself!! ... Insurance is there for a reason...

... if it was a little $200 scratch or scuff then sure pay it!! ... but around $2k?? ...  :icon_eek:

One other point about her insurance not paying because she was on a motorcycle:  Sure, if it is up to her ins company!  The people who answer the phones at the insurance company are trained to say "no" the first time someone calls.  But if your insurance company is involved, they very well will try to get hers to pay them!  Then the answer is not always "no".

Adding on to this -- the people who know how to get money from insurance companies ARE the insurance companies.

You can speak to a rep from your insurance company without filing a claim, right? Her insurance company may not want to pay out, but I'm sure yours won't either, meaning if you file a claim they'll try and collect from her company if there's any legal way they can. And I don't know enough about insurance to advise you farther.

And if at all possible -- do it quickly. You don't want to anger the person who thinks they're out money on their car. Also, regarding that, see if there's any way you can go to the body shop with the car to get the price down -- $2k is outrageous unless they're replacing the paneling along the entire side and repainting the entire car.

Yeah, I'd want to see the itemized estimate for the car repairs. It's not that I don't trust them.....but I don't trust them to not try to get something extra out I the situation.

Out of curiosity, where are you located? Here in the land of no fault insurance, the car owner files with their insurance company who then works with your/her insurance company to collect funds. Unless said car owner doesn't have comprehensive insurance in which case they are the ones getting screwed. Small claims court cases are a waste of everyone's time.

LoL, she has agreed to pay for all the necessary parts for me to fix the bike. She won't be able to pay me until the end of October though, fingers crossed I don't get screwed.
