Did I Get Scammed (Ebay)? What do you think?

Hi-T

I picked up a set of CBR rearsets.  I knew that they were old and the seller said that they were used but in fair condition. Check out the Ebay Auction.

So they arrive yesterday and I go to clean them up and the left is broken.  The bike low sided and cracked the rear set and also slightly bent the shifter level- putting some extra play in it.  

Check out the pictures HERE.  The crack is between the shifter and peg and is complete.

Tell me- are these in fair condition?  Would you use these as a spare?  Would you trust these on the track or through the canyons?

So wadda ya think?

dude if that crack was there when you got it, you got ripped! its not in "fair" condition if its cracked strait through and bent. thats called BROKE!. i did notice in the pic he had on ebay you couldn't see that crack from the angle the pic was taken.he knew it was junk and is hoping you will just live with it. his terms did say to contact him in 3 days if there was a return so i would get to it and get as much money back as i could. the only thing i can think of if you keep them is to get it welded as long as it can be and if you can find a  welder that will touch the job, they don't want the responsability of fixing "iffy" parts. plus you would have to get the bend out somehow if its that bad.

he didn't describe the item the way he should have...it's broken and that's not "in fair shape"

just leave him bad feedback after he leaves good feedback for your payment

If you only saw the crack after cleaning he probably didnt either, althoug he should have stated they were in a low side.

The guy emailed me back and said he'll refund everything but the shipping (10 bucks plus 10 to send them back= 20 bucks in the hole).

The crack is too obvious to miss, even dirty.  The guy insists that they were as described and still usable.  I asked for a full refund on the broken set and said I'd eat the shipping on the good set.  

Unfortunately, the earlier years rearsets are kinda hard to find.  Before I do the mod, I want/need a complete pair off the same bike.

Anyway- we'll see what happens

I've got a set of those just sitting here. I bought them with the intention of installing them but never got around to feeling like I needed them...so there they are. Complete set. See my site for the photos of them. I started to do the work to get them on but stopped well short of finishing.

I paid a bundle for them but if you want them they're yours for $40+actual shipping. Let me know.

Have it welded. I like how he had the shift lever in front of the crack on his ebay auction.  :roll:

Jkstyle, I've traded thousands of dollars on ebay and have done ok so far-  You have to place some trust in your buyer that they have some sense of business ethics- and this guy does... I emailed him the pics and he agreed with me- he said he didn't note the crack and will do a full refund.

My fear with welding- the fact that they took such a beating to begin with is troubling- There may be other cracks hiding that may break.  too bad- you can see the right rearset cleaned up perfectly...

PANTABLO- I WILL TAKE THE REARSETS!!! You have a PM- I just checked your site and I like what I see.  Let's deal.

How much did you pay or them? I may take them offyour hands for race spares. A weld will work fine on it.

I bought each for 20 and paid 10 in shipping- I'll take 40 for them (he's refunding 45).  I wish I could lower the price but... and you've seen the condition so...

Let me know ASAP.  I was going to ship them back tomorrow, but if you want them then I will wait.

For the record, the right side is in better shape- cleaned up pretty good but you can see the pegs were dragged.
