have to have full coverage, over 10k in insurance, and over 21

they have a law like that here in Texas either 25k insurance or pass the MSF course.  In Oklahoma my home state helmets are strictly optional.

but, those same people are going to drive stupid whether they wear the helmet or not....just w/o the helmet they have a higher risk of dying.

In Florida you don't have to wear a helmet either. I think you have to have some sort of medical coverage though. You don't need to have motorcycle insurance here either.
I'm for the helmetless choice. If you want to ride without do so, your a person, you have a choice, it's upto you. I personally always wear my helmet as do about 99% of the other non-cruiser bikers around here. It seems to be just the harley riders who don't wear helmets.
