Title: motorcycle accident

hey all, this is only my second post, but i have been visiting regularly for about 6 months.  two weeks ago i was in an accident in my gs.  i was on a street, with two lanes going in each direction.  i was in the left lane, on the right side.   With a car about a block behind.  This black SUV pulls out of his driveway right in front of me and blocks both lanes, and crosses the double yellow line. i try to swerve left around him, but i was going to make it i was just gonna slam into him, so last second i layed the bike down and whent under his trunk and through to the other side.

I will be ok, i didnt break anything, and my bike only has minor damage.  I have pretty bad road rash on my leg, and bad pain in my knee nad back.  But my jacket saved my arm and shoulder.  Oh and i havent been able to walk well (i cant bend my knee, and there is too much pain). and have been unable to go to work.  My question is there anybody else familiar with this kind of accident?  i already have a lawyer, but what kind of thngs should i do, and what kind of compensation should i expect?  The guy has insurance and so do i.

And to everybody now i cant recomment enough to leather knee pads, or leather pants with armor.  Cause even though my jacket and my helmet saved me from the worst pains.  God the pain in my leg and the road rash is horrible.  As soon as i am well enough to ride, ima buy a pair to protect my legs.

Sounds bad. I'm glad you're at least alive though. Unfortunately I don't know what to do in this situation either, but I'm going to look at the responses just in case I ever need to ;)

Sounds like he backed out into oncoming traffic.  He will be found guilty just like people hitting smeone from behind.  He backed into oncoming traffic.

Glad your ok Winter.  Looks like the law should be on your side but more importantly....your alive dammit...!!!! :cheers:

good to hear you came through ok, winter...  neosporin with pain releiver works well on road rash, and i found soaking in my pool whenever the skin pulls tight helped for flexibility, also lukewarm baths help.
my doctor told me I had much less scarring because of the frequent soaks also.
Sue the crap out of the guy, even if your insurance company doesn't. I have found that insurance  companys don't always do what is in YOUR  best interest, they generally just care about theirs... so if your waiting for them to initiate a claim against the other driver for injury, or pain and suffering, you may be waiting a long time.
not sure how things go where you are, but here, about 250 lawyers would have already called soliciting their services on a case this easy. you may want to look up a free consultation, and make sure the lawyer you choose is familiar with motorcycle cases.

I'm sorry, man.  Too much of stupid behavior by cagers going down lately.  :(

Document all of your pain at medical visits - you want to have everything that was the result of this collision covered by his insurance.  If you have a lawyer who does this kind of representation usually, he or she will give you all of the advice you need.  If your lawyer doesn't usually do this kind of representation, get one who does.

that sucks good to hear your ok though. i would sue him bigtime people like that are idiots and dont deserve to drive i had a cut me off in my truck a 69 c20 big beast and he cut across 3 lanes to cut me off.  so i say sue them

I know this may sound like it would do more harm than good, but it won't.  This is experience talking.  File on your own insurance as well as his.  Check to see if you have PPI on your insurance.  If you have comp and collision you probably do.  After you get a copy of your police report (should be available in about three days after accident) and find out if (that) the other driver was at fault, file on your insurance.  Then your insurance company does all the work for you.  They want to get their money back so they'll do all the negotiating with the other driver's insurance company.  This cannot be held against you (it is illegal) if you are not at fault in the collision, which it sounds like you are not.  If you have a lawyer, he probably already told you to do this, but just in case...
