Title: Buying a gs this week, need some help answering a few questions.

Hey all...

i stumbled across a deal on a gs but have a few questions...

the owner of the bike died on march 23rd, in an accident on a newer bike...

therefore the family says that they have to date the title before the death of the owner, which was 2 months ago...because there is  still a case open on the accident and they would have to wait for an estate to be built till they could sell the bike unless they date it before he died...

will i run into any issues, or issues when trying to register this bike or pay taxes in va?

please help asap! : )

the only thing I'm aware of, and this is california law...


FORGING A BILL OF SALE IS ILLEGAL.



that and there can be a fine for failure to register in a timely manner.

hrm....so perhaps they can transfer the title to a family member, then i can buy it from that person?

so long as you buy it from a living person who is the current owner you should be fine. if they're trying to avoid estate tax issues or whatever estate issues, they need to do what they need to in order to avoid them. dont put yourself in a compromised situation.

If the deal sounds too odd I would leave it. There are other bikes.

stuff it id do it, if he genuinly did die id say they were just trying to avoid the taxes,
i would get something in writing from them to say that they are selling the bike on behalf of the dead guy,
just so if it ever comes back on you you have a leg to stand on.
so it'll just be his ghost to worry about :icon_mrgreen:

Agreed: it would be a headache. Keep in mind that you would be responsible for any damage/mahem caused by the motorcycle from the time the bill of sale is date... :cookoo: Another truly good one will come your way; be patient!  :cheers:

"Deals" aren't always without strings.  Run away!

Wait for something better to come along, there's no point in getting caught up in that mess just for a GS.  Not only will they have to forge a bill of sale, but forge a signature on the title, and figure out how to release whatever lien might be on it.  Not easy things to do if you're dead...

I once bought a bike from a dead guy, or rather a dead guys estate. All the legal stuff was done by the Solicitor (or Lawyer) appointed to read the will and handle the affairs The money I paid for it was shared out amongst the dependents. I dont know how the system works over there but the deal seems fishy to me. Maybe the guy died without making a will and the family are trying to sell the bike without it being included in his estate to avaoid duties. Or maybe some of the dependents dont know about the bike and those that do are trying to sell it, get the cash, and split it between them while cutting the others out. I suppose all that matters from your point of view is that you end up with a legal title to the bike. If you think its a good deal and are keen on I would approach a Lawyer and see where you stand because this sale seems far from straightforward.
