Do you think I could sue the county if I were going down a mountain road at the posted speed limit, and hit a patch of sand and broke myself?

Just wondering since I almost flew off the side of bogus basin road today. There was a few corners with just enough sand to make you get wiggly...

Glad I wasn't driving too fast through that section, could have been a bad day.

Edit - - - Maybe I should notify them so no one else gets hurt, so that someone that isn't driving safe wont kill themselves. BTW, it's a joke, for all the jerks out there.

No.  The county likely has governmental immunity from suit.  There are only two exception to this rule: the negligent operation of a governmental motor vehicle, and maintaining a dangerous condition on governmental property.  And even under those exceptions, there are caps on liability (but they are around 300K). 

But I don't claim to know where you live or the laws of your state.  You should consult an attorney in your state.

Someone sued the county I live in because when they paved they left a rumble strip like mark in the lane not on the edge like on the highway and a biker hit it and totaled their bike...they won..$50k and they had to fix the road

Do you think that is different than having sand on the road?

Or do you think that that is maintaining a dangerous condition on governmental property?

Prolly way different than the sand, of course you can't sue in NY between October and the end of May for anything having to do with road conditions.

The roads in Kansas City are so f'ed up that what you want to do is drive in the pot holes and try to avoid the patches of pavement.

You might as well join the masses and sue them so our taxes can go up.  Every body else does.  It doesn't matter that you are in control of the bike, part of knowing how to ride is to judge the available traction and adjust your speed accordingly.  If you crash on sand or gravel in the road, it's your fault, dumbass.

My problem?  Some one almost crashes because of a lack of experience and riding skills and it is the counties fault?  How about trying a little personal responsibility on for size?

I don't understand how you can have any grudge agains thte county after admitting you had already experienced a couple curves with sand on the road.  Do you remember when you took your driver's test?  Yeah one of the questions was "is the posted speed limit appropriate at all times?"  Remember that one?  It's not.  The posted speed limit is appropriate for nominal conditions only...that means if it's dark, stormy, windy, foggy or if there's sand on the road it's not considered safe to drive the posted speed limit.

theres no point in trying to sue . the county can not keep every road clean ..  that i know of .. i dont think they clean a road . id say its not worth it . . just watch the road look ahead if you see somthing slow down  and procced with  care

First of all, I had never been on that road before, except in a car. If I go around a corner at the posted safe speed limit I expect to be able to go around that corner without sliding off the thing when I've taken about 45-50 corners on that same road that didn't have sand on them. The only reason I didn't bust my ass on that road was because I was riding safely. I came around a corner at a safe speed cautiously and still almost managed to wreck my bike because the road wasn't clear of an obviously unsafe condition. If a car had come around that corner in my lane and hurt me, I'd have sued the shaZam! out of him for being stupid and driving in the wrong lane. If an unsafe condition exists that the county could have prevented, i.e. clearing all of the sand off that it dumped on the road to give drivers traction during snowy conditions (should have been cleared 6 weeks ago when the snow was completely melted), I wouldn't have brought it up. Thanks to all the people that automatically assumed I was driving fast and being stupid. That's the same attitude I see from most cage drivers, when they see a bike smashed into some guy's door because the bike didn't have time to react.

It has been raining a shaZam! ton.  Rain washes crap onto the road.  My favorite loop of twisties always has a couple areas with gravel and sand washed across it.  When I see that shite, I slow way down with the quickness and ride across it slowly and without leaning.  But that is just me. If I remember correctly, I prefer to crash in heavy traffic and at night.

Ok, this started out as a small joke about the conditions of roads, but has gotten really stupid, really fast. I dont have the money to sue anyone even if I wanted to....but I'm not going to argue, because I dont have time....feel free to discuss, but I have no more input....
