It would probably be less painful.
First and foremost, I am an extremely responsible rider who rides within my own and the legal limits. I do not condone such squid-ery, and I feel that people who ride and act like this give bikes a bad name, raise our insurance and will some day be the end of high powered street bikes.
What makes me furious is the police officer thinking its okay to take someones life (easily done even at 40 mph) just because they decide to run from the law.

In most metropolitan areas, a high speed chase is one of the most dangerous issues for bystanders.
I think if you have an honest to god runner, one properly place round is the safest method of control. A stray bullet in traffic is far less hazardous than a 120 mph vehicle.
You hear about high speed chases and often it is a repeater. Someone who just gets a kick out of endangering everyone else.
Unless someone actually dies and they get vehicular manslaughter, the punishment is not significant.
