Title: UPDATE on my rear-end accident.

The asshat's lawyer requested a "final" court date.  I can't remember what it's called, but according to the Victim Witness Advocate (today's temp wasn't as cute as the advocate that usually works there...)

oh yeah...  according to the VWA, this court date..


DISPOSITION DATE!!!  That's what it's called...

...  this date is kinda like a final date where the asshat is asking more time to pay the restitution and he will make a plea as to the charges.








SIDE NOTE:
The blood-sucking laywer had the odasity (sp) to tell me that "it seems to me like you're replacing EVERYTHING on the bike."

Obviously, he can't read a repair estimate...

But the statement that REALLY pissed me off...  "It also looks like the exhaust is only COSMETICALLY damaged...  It's fully functional, right?  So we can forget about the exhaust portion of the estimate?"

I really wanted to ask him at that point is it would be ok for me to go outside and dent all the panels of his car.  Since the panels would still be *FUNCTIONAL* and the car is still *DRIVABLE*, I wouldn't have to pay the repair bill, right?!?

Tell the Judge what an ass hat this guy and his lawyer have been.  Then tell them that you back hasn't been right since the crash.

if you don't already have one get a lawyer for that date.  Tell him how the defendant and his lawyer have been treating/harassing/badgering you.  then get your money.  :thumb:

PS : Get a better can out of the deal cause they are both asshats from the sound of it :laugh:

I don't have a lawyer.  I don't need one just yet.  This whole thing is still in the "pre-trial" phase.  It's basically the Commonwealth vs. Ashhat (oh..  and Asshat's brother too.  heehee :icon_twisted: ).

I'm not involved in a direct way yet.  The DA's office (specifically the Victim Witness Advocate, Kristen)...

...is trying to get my restitution at the SAME time as his conviction.  If this can be done, then I won't have to go to court against him myself.

That would be cool if you could get restitution without having to fork up your own resources.
What is he/they being charged with? hit and run?
(I hope they get but raped in jail)

I hope so too.  Although I don't really like the idea of MY tax dollars paying for HIS room and board at the county jail.

Maybe he could jus tbe locked up each night with Bubba and Joe.  When daylight comes, release him.  Repeat process.

yeah.  I was REAL lucky that day.  I was pretty much 1st in line at the light...  I could have been thrown into the middle of the intersection, but I didn't even go down.

well hell an, all youre wanting is to have your bike the same way it was before the accident, am i correct, so even if it was cosmetic, its still damaged. most of which cannot be repaired to 100% original

Fleeing the scene of a property damage accident and also driving without insurance

he's doing his job trying to whittle down the settlement. you stand your ground. I wish you well but to think you dont need a lawyer at this point is foolish. dont fight a lawyer without a lawyer on your side.

I'm not involved directly...  yet.

Right now, it's just the court vs the asshat.

IF the DA can't get my restitution, THEN I take him to court.
