Title: trademark violation on ebay?????
Post by: porsche4786 on July 17, 2007, 08:29:51 AM
Okay, I listed this listing on ebay ... http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&ih=006&sspagename=STRK%3AMEUS%3AIT&viewitem=&item=160134212929&rd=1&rd=1 (http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&ih=006&sspagename=STRK%3AMEUS%3AIT&viewitem=&item=160134212929&rd=1&rd=1) then they never sold, so i reduced the price and relisted them. But then a few hours before it ended I got an email from ebay saying they took my item off ebay because "The rights owner, Puma AG Rudolph Dassler Sport, notified eBay that this listing violates intellectual property rights." Ebay says it is a trademark violation. What is wrong here?

I don't see the problem, and after a quick search of ebay's policies, I didn't see anything that would prohibit you from selling the shoes.  Were you're listing fees refunded or not?

Puma may have had problems with people selling counterfit shoes or may have strict policies about only licensed stores selling their shoes and requested that the listing be canceled.  I'd ask ebay exactly why your listing was canceled

Yes, they are refunding my listing fee. But the thing is, I bought these on ebay. And the guy sent the wrong size, and I didn't want to pay to ship them back. I know I know, he should be paying for it. The shoes did get shipped from china though....so I wouldn't totally doubt if they were fakes, but the quality is just as good as the rest of the puma shoes I own and the leather is really soft, so I don't know that they are fakes. I'm just going to relist them, I don't see a problem, it's not illegal to sell a pair of shoes.

If they are fakes it is illegal to sell them.  It doesn't matter if you "know" if they are fake or not you have to prove they are real.

Does Puma make a show that looks like that?

They make a lot of ferrari shoes. I have not seen these on their website, but then again, I've been to the puma outlet store and haven't seen any of the shoes there on the website either. so it'a hard to tell, but I thought these on ebay from a guy who sells them all the time, he still has all his shoes listed on there.

I emailed ebay asking what exactly the problem is and to let me know. I'm not trying to break the law, I just want most of my money back for these shoes that I bought on ebay, if anything they should go after the guy selling them.

The complaint may have come from another ebay seller selling similar shoes. The same guy you bought these off even. Some sellers will do this so they dont loose any sales of there products.
If they are fake, you could try listing them without actually stating that there made by Puma.

That's a good point. It pisses me off though cause I had like 5 watchers and like just a couple hours left! So they probably would have sold, figures.

Try again but this time without the word "Puma" and see what happens.
The down side though is if you don't get the price you want, it may have been better to have paid the postage & sent them back.

Best of luck.

Also if you borrowed the pictures, say from the seller you got them from, that could be why it was taken down.
