even if you are passing on the right, its still the cars fault for failing to yeild.

no matter what anybody is ever doing, if you are changing  lanes, you have to yeild. end of story.

QuoteWeehawken Police Sgt. Sean Kelly said the collision occurred at 3:30 p.m. as Clooney and friend Sarah Larson were traveling north on Boulevard East and sped up to pass on the right a 1999 Mazda Millenia that was preparing to make a right turn.

Kelly said it is not known if the driver of the other vehicle, who has not been identified, had used his turn signal. Boulevard East is a narrow road with sweeping views of the Manhattan skyline.

Doesn't sound like it was a lane change.  Passing on the right is illegal in most if not every state.  It could have been that the cage was slowing without signaling (or even put on the wrong signal) and Clooney attempted to pass on the right.

Either way, no matter whose "fault," the motorcyclist always pays a greater price!
