Unfortunately, *I* didn't make the ride, either. But my bike's in surprisingly good shape, and cagers suck. Cager did one of those no-signal, no-looking lane changes in the spot that I was going to be occupying in the next 2 seconds while I was lane sharing. I went over the bars. My bike's fully covered, so I'll get him fixed (I don't know if it'll be in time for my first track day, but I'm gonna try).
Amazingly enough, there was a BARFer sharing lanes right behind me who witnessed the event. I'll be posting up in crash analysis when the shock wears off.
He also picked me up, helped pick my bike up and get us both out of the lanes (both my bike and I ended up in the #2 lane), and stayed with me the whole time. A big, HUGE shout out to fellow Barfer, fogtown. I'd never met him before, but he took care of me like a brother, and he didn't leave my side until the CHP was done taking statements. I can't say enough about his good heart and kindness.
I just sincerely can't thank him enough. Words just aren't adequate. Thank you, thank you, thank you, fogtown!!! fogtown deserves some real BARF love.
I hope the ride was a bit less exciting than my attempted commute to it.
P.S. The Waaaahmbulance was offered time and again, but pandyz don't need no steeekin' waaahmbulances, and they weren't offering me a nice helicopter ride, so forget it!!

Thanks, all. I'm sore but alive. Police report taken, but won't have those results for 8 days or so. Responding/investigating officer is a new rider, so hopefully he understands that it's not always the biker's fault. I'll prolly go to the doc's today if I can catch a ride (bike's my only transportation at the moment). I would have gone in the waaaambulance, but there was no way they were towing my bike while I was still breathing. :nono:
Besides, I'm tuff...I rode him home. :flipoff:

Anyone know who does crash estimates in the San Mateo area? :cry: My insurance company is already on it, and they called the driver's behaviour an "unsafe lane change." Of course, her insurance compandy will say something different, but I'm hoping having a witness will help (as well as an officer who understands riding/riders). It'll be interesting to see what the popo report says... :icon_confused:
Edit: Oh yeah....gear report. Was fully geared. My helmet is toast; my head hit hard, and there's a chunk missing now (Scorpion EX-700 Crackhead). No body rash at all, just badly bruised down my left side, which is where I landed after going over the bars. One of the bars got me as I went over, and let's just say I'm glad I'm not a guy, cuz I'd never have children or sex again if i were. Boots worked; moto pants worked, armoured jacket worked; helmet worked; gloves worked. ATGATT. I haven't checked them over yet. Insurance should cover the gear, especially if it's hers paying. Bruising where I landed, headache, neck ache, a little dizzy, but lucky lucky lucky.

*shudder* This whole incident gives me deja vu - I had a very similar accident last summer on 680, where a pickup changed lanes in front of me and threw on the brakes - luckily, I only lowsided in getting out of the way rather than going over the bars, but I skidded for quite some distance. Leather Alpinestars jacket really came through for me though. I'm paranoid now though...should a cup be recommended protective gear?

My baby's likely to be total'd, but the shop is going to work with me to try to keep that from happening and get him fixed up. I'll get him back into tech spec for my track day (oh HELL yeah I'm going ;)), and then we'll fix him up after that (new Yosh pipe perhaps?).

im assuming cager is at fault. that being said, id let it get totalled, and with teh pain and suffering settlement, buy it back as a track bike. and a new sv or something as your rider. if you werent so far out, id letcha have this older car ive got sitting. and finally, yes vicoding is your friend. dont let it become your lover. ive still gota dozen or so left over from my days in icu. im tempted to use em, for aches and pain an stuff. A thought just occurred to me tonight, and it has me stunned:
Today's been a really crappy, painful day. I was laying on my bed thinking about the damned accident...then I sat up so hard it hurt like hell when a thought struck me.
OMG. I can't believe I didn't think of this Monday or yesterday.
The accident happened at about 6PM. We were in the diamond lane. THE OTHER DRIVER WAS IN HER CAR......****ALONE****. She was illegally in the carpool lane. What are the chances that she was diving out of the lane because she thought a cop was around as she chatted on her cellie!!??
So..while the biker behind me was calling 911, the other driver was on her cell (which had been glued to her ear when she got out of her car). About 5 minutes later, a car with I think 3 people pulls up, and a man gets out that I assume is her husband. I didn't think anything of it, because I figured he'd come to support his wife.
I didn't hear what statement they gave the cop, but what if s/he claimed that her husband was WITH her in the carpool lane!!!!???? OMG.
In my shock on Monday and Tuesday..and, heck, until tonight, it didn't even REGISTER that she was in the carpool lane ILLEGALLY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
I don't know what this means for me legally, but I'm calling my insurance first thing in the AM (I just missed the closing of the claims office tonight). OMG. This has just stunned me all over again. She was in the carpool lane illegally, and her husband(?) shows up and sticks around while the rest in the car then leave...and she and the man (husband?) then talk to the officer together.
Does the fact that she was illegally in the diamond lane (alone in her car) have any bearing on the case?
Ugh..I'm just sick to my stomach thinking about the whole thing (and from gritting my teeth through the pain ).

Interesting how stuff like this starts to come out days later. It's happened to me, replaying stuff over and over and over in your head. It takes time for the details to come out. I would definately make the police aware of that fact.

Just my opinion: unlawfully using a HOV lane generally isn't a moving violation, so I doubt either insurance company will care. (Never hurts to mention it though) I would stress the cell phone thing, especially is fogtown can verify she was on the phone. A lot of states have adopted enhanced penalties for moving violations while using a cell phone, maybe you can get her off the streets for 6 months.

We were in Paris for five days at the end of our trip. The population density is something like 20x that of NYC -- tons of people in a tiny space. Scooters and bicycles and motorcycles everywhere. Lane splitting is de rigeur. I saw no one without a helmet, however.

Yes, you've pretty much nailed it here. I reported it to my insurance company, and they didn't care all that much. I also asked on a LEO forum, and they pretty much answered as you did above: the fact that she was illegally in the carpool lane doesn't have any bearing on blame/fault finding.
Things definitely do come out as I replay things over and over and over and ....etc...in my head. They seem so damned relevant and like such AHA! moments to me, but I think the only place it's really going to matter is if it goes to course (ie. if she told the police her hubby was with her, then she lied).
I've just got to hope that having a witness helps, and hope that she's not really evil, and hope that I'm not screwed just because I'm a big, mean, rough, tough biker chick. :laugh:

You'll hardly see anyone riding without a helmet on this side of the pond...it's pretty much mandatory everywhere, even riding mopeds. :thumb:

Insomnia happens with opiate based pain relievers, ask your Doc for Lunesta. It doesn't adversely interact and works freaking awesome.

Actually, I moved back to socal a few months ago. (Yeah, I know, booo socal, but it's not permanent.) Incidentally, one of the few things I like better down here are the double yellow carpool lanes. It cuts down on the number of idiots like the one you encountered.

I probably won't get the report until next week sometime (CHP says it takes about 8 days to process), so I don't know yet. I have obtained some legal advice, and he said it'd be a miracle if I'm not assigned some % of the blame. :bs: So she's doing all sorts of illegal things, but I"m the one who sits here suffering, and I'm assigned blame just by virtue of the fact that I'm an evil bike who's legally sharing lanes in a safe and prudent manner, as dictated by law. :mad: Don't get me started! :laugh:
I just really, really hope that having a witness helped, but the atty didn't seem to think that there was ANY chance that she'd be found completely at fault (even if the cop had been right there, witnessed the carnage, etc...bikers are still evil and to blame).

I tried to get by with just the muscle relaxers and Vicodin today, but it was a no-go. Still need the opiate-based pain killer. Will try again tomorrow. And I really was hoping I'd be able to start riding again as of last night. :cookoo:

We couldn't go to the top of the Eiffel -- the top was closed when we got there. We went to the second level (which supposedly has better views anyway) and the first level. We took the elevator up (long wait) and then stairs down to level one, and stairs down to the ground. 720 steps to each level!
I have many pictures from the Eiffel Tower and lots from the Louvre as well. It was an incredible trip -- we'd been saving for it for three years since we last (and first) went to Europe. We had never been to Paris, and it was fantastic. Forget everything you've heard about French rudeness, etc. -- it's not true as far as I could tell.

I also just heard about this, sorry this happened but I'm glad that your were wearing your gear. ATGATT. Get well and heal up soon and get back out there! Hopefully there won't any problems repairing and/or replacing your bike and just as important replacing your gear.

I'm hitting the road again today (noooo no literally, you goofs!!!). Today's my first flight....er....ride since my crash. My bike's still ugly, but he's ridable. :bowdown:
Er..... ok... here's something to keep you amused while I'm out there going OUCH....DAMN...OUCH....*THAT* didn't used to hurt......
This happened yesterday:
I was turning my bike around in the garage yesterday...yanno be all ready for this morning's ez takeoff.... I tried to start my bike...and he wouldn't...After two weeks, I've forgotten how to ride....
Ok... I got on my bike to turn him around in the garage (first I went OUCH...then adjusted..then not so ouch...how come we always have to nail the most painful part!? LOL...stop laughing :P )...so... I get on my bike, turn the key.....make sure the kill switch is properly set...check...push the starter. Nothing. Lights are on. Push the starter. Nothing. Sigh.
I figure i'll turn him around by walking him...sigh..... Great....dead bike....group ride Saturday....GS ride Sunday...and dead bike... So I put the kickstand up..and that's when it hits me...duh...need to be in neutral or kickstand up to start him...duh. Push starter. VrooooOOOoooom. :icon_lol:

I hate to say this but although CHP has officially said lane splitting is ok by them there is no law clarffying it's legallity. You will probably be faulted for failing to operate your vehicle within the confines of a single lane.
Lane sharing meaning 2 riders can ride side by side is what is defined by law, had a post about this on another forum I linked to from a thread on here a while back.
Yes, unfortunately you're right. The biker can be operating fully within the law, and the cager can be doing 16 different illegal things, but the biker will be blamed (especially since cagers lie). Ask me how I know this. :icon_rolleyes:
Lanesharing may be legal in Cali, but if anything goes wrong, the lanesharer is too often blamed.
look at the bright side, you're alive to fight the cager and their insurance dickheads. :icon_mrgreen: you can even ride the bike to court. :laugh: seriously though, glad you're on the mend. don't stress the cagers. i learned the hard way that sometimes even if you're right, they (insurance company) will still win. i learned from personal experience. i got hit by a car turning left. i was walking. long story short, i got told, flat out, i shouldn't have been walking there. :thumb: :mad: :mad: anyways. best of luck pandy! :cheers:
