now for some reason im thinkin what teh hell. im not  making money. i htink the only claim they may have is public exhibition?

i was readong somewhere there are a creative usage clause of some sort for things like this. im trying to find it. if i have to or want to appeal this, uif not what the hell ill let the Buddha Loves You stand as is.

I think that they are entirely correct and have rather kindly let you keep it. I imagine this happens to millions of videos on youtube, there are so many music songs on there you might as well not download them. And that is the point.

For every person who listens to the song on your video, is one person they could claim might otherwise have gone out and bought the song. Thus loss of revenue.

Infact its very unlikely that be the case, and can actually work in the opposite direction, but the claim is true.

the problem here is that you are using a mp3 ripped off of a cd (or downloaded thru iTunes, etc).  Its the media to which the author (or whoever bought the rights off of them, or if they're dead whoever they assigned the rights to, or the label who owns publishing rights, yadayada)  could be a thousand scenarios... if you want to get around it.  record your own version.  They cant do anything about it. 

On the radio when songs are played Royalty companies (ASCAP, BMI, SOCAN, etc) take a sample of the airwaves and pay artists accordingly.  Theoretically, YouTube should be paying artists for 'airtime'. But instead they give the option of 'oops... we didn't know people would be using copyrighted material...here... go ahead and delete it' so they don't have to pay any fees... probably like a radio has to pay certain fees to publicly play copyrighted material.

Its also to do with the content benefits the place where its being displayed etc etc.. you tube gets hits for having it up there, whilst at the same time the record company loses potential customers.

Hence why you have to pay more to show sky sports in a pub even if only 3 people are watching it than if you had 30 people over to your house to watch it on your telly.

true. but i see so many playing "copyrighted material" without the adverts. meaning theyve not got caught yet> im not going to dispute it. hell after a few turi shots, ive mellowed out. and am seeing things the same way yall are. that aside. do i do this again? , if so to do this do i ask their permission to do so? or, hell idk whom to even ask   :laugh: :laugh:

if you want to be safe... either use a song you wrote or your version of someone elses song (could be Aerosmith, Timbaland, your next door neighbor, whatever).

but I wouldn't really be concerned.  They aren't going to tag you with a $500 dollar fine. (i believe thats what it is for using copyrighted music incorrectly... mind you thats per song per play...yikes).  But  its like RIAA and downloads.  They don't go after the small fish, just the big ones.  Worst they would make you do is take down the video.

true im not worried bout it. what tehy got me on is the title and artist. i believe a proggy caught that. cause if you look at my others many more, have not been caught. so ill re do the title artis t thing. somehow

hell i got flagged 3 more times tonight. , i emailed UMG via their YT page, and asked them what must i do to use their music.  i listed what proggies i use. 1. moviemaker 2. fraps. and 3. a tune i await their decision lol btw UMG = Universal media group

this is complete bullshit. fair use should cover you playing a cd/dvd in the background or editing it into your YOUTUBE video as a soundtrack. you're not profiting, so they should have no rights.

i say EFF the music industry. they make MILLIONS off a song, and think they own it forever. here, i'm singing "Happy Birthday to You" right now. Sue me.


(google "happy birthday song lawsuits" if you don't believe me, it's quite stupid)

you need to download a program... google something like 'downloading videos from youtube'  there's a quite a few options if I remember.

yup and one to convert as well. YT vids are .flv whereas dvds are not
