Anyone know what to do about a law suit if needed? or how to avoid one and still get my medical bills paid?
I went to a ECHL (Johnstown Cheifs) game tonight. On the way in, all the sidewalks/roads are dry, we have had no snow or rain in some time... in front of the opposing teams bus (parked near the main entrance) they apparently dumped their water coolers from the ride... well... it froze, I didnt see it, fell and broke my ankle!!! :mad: I still went to the game (WE WON) =) then went to the ER next... so now what? now I have no insurance and a $300 ankle boot $$ for xrays, ER fees and prob like $500 for the doctor to just touch my foot...
Who do I go after? the arena? I feel they are responsible seeing as as soon as I told them what happened they ran out and put salt on the area... I then filled out an (incident report) where they would not write down much of what I said... I dont think I can blame or go after the other team 1. they are from out of state 2. I think its the Arenas responsibillity to keep the area clear... No?

Did you take pictures of teh dumping teh stuff you mention?, TBH id get a police report, then move forward from there. and get ahold of whomever belongs to that bus the team im assuming. this is by no means legal advice. get this stuff, tehn if you have to get ahold of an attorney. i know JakeD here is one. pm him and see what his opinion is. not sure of other people here if anymore attornies or not. best i can offer. witnesses could help as well
The venue owner would probably be responsible. They will likely want you to sign off on any further claims for compensation. I wouldn't recommend doing that until you are completely healed, as there can be unforeseen complications that could cost far more than the original injury. You need to act quickly and round up witnesses. Any chance it was recorded on video? Even so, how will you obtain it before it evaporates? Like 'em or not, that's why you seek the services of an attorney.

I'm a law student, so you basically can't listen to me. In fact, just ignore me all together.
The fact that they salted it after you fell doesn't mean they were responsible.
They had to have a duty to protect you from dangers they were aware of. If it was raining and freezing, then they would have had to put out a walk. The venue owners probably were not aware that water was dumped (unless this happens at every game in the same spot where people walk) and thus did not have a duty to fix it, unless they were aware of it.
It may be the team's fault, not really sure. Just to be a typical law student, I will say: it depends.
I would recommend going to speak to an attorney. It's 2:30 AM where I live, and I've been writing about trademark law for the past month--I'm very rusty on my torts, and the information I just typed up has a high likelihood of being incorrect.
You could always send a threatening letter to the stadium or team and ask them to cover med fees. Your hospital fees are just a drop in the bucket for them, and they may just prefer paying you than an attorney twice that just to read your letter.
PS Does anyone know any trademark attorneys? I'm looking for a job this summer.

I had the wife take plenty O pics of the ice and everything, filled out anincident report, wrote out my version of the story when I got home and contacted the arenas insurance who says they will take care of it.... ( the med bills and all)
Now... Like gearman says, what if this causes further complication down the road?
free legal advice is usually worth what you paid for it.
Call a lawyer. They will usually do the first consultation for free, then bill you from there for their services if you decide to continue. They will usually ask for a retainer, or a few hundred dollars to set up an account against which they can bill you. Then again, personal injury lawyers might not even do that if they think they can get a pay-day from the person that you would be suing.

As far as ankle injuries they linger. Last year I dropped my Gs on my ankle. Doc still can't comprehend how I managed to get my right ankle under left side of bike. Guess, I'm talented like that. As soon as I stood up from the incident it was already black and blue from swelling not good. After getting my bike six miles back home looooong ride. Had to get to my friend's house to get my car even longer drive. Learned how to drive left footed very quickly.
Well, nothing was broken. But, ortho said I was better off if I had. I tore I believe three ligaments. After six weeks of crutches, another month of the walking boot, six weeks of physical therapy, another two months of a strong strap brace, and a few cortisone shots was free enough from pain to get through a day. This happened last Good Friday my foot/ankle is still very stiff and with last night of a six hour shift in cool weather it was stiff to the point it hurt to walk. Riding, would have been torture if it had not been the boots Pronator just sold me to give me support.
Just to let you know how long ankle problems can linger! But, you may be different do you have torn ligaments etc... All is different!
Hope you can get some help because the walking boot is expensive, then the PT with Insurance was $20 a trip three times a week! I did it at my pain management doc who I had for five years already and they cut me a deal. Did you get a walking boot if not I still have mine if you will need one. Also, when getting out of the cast,boot the ASO ankle brace is the best but expensive as well.
If I can help shoot me a PM. Ankle injuries suck. was it the left or the right? Believe it or not I found riding the bike much easier than driving the car. After walking cast came off that is. Because, you do a lot less with your right foot on the bike than you do on the car. I learned to drive with two feet like NASCAR lol! I found driving probably not a good idea for the first month because no way could I have slammed on the brakes. But, I have no family and many doctor appointments. For the first three weeks I couldn't even put my foot on the floor without pain that was the worst for me esp. with the heart problem. Just getting to the very back of Wal-greens to get an ice pack was torture. Then an @$$hole cut in front of me! It was a very long line but nobody had sympathy even though I was almost in tears! Oh, well.
I hope you have a quick an uneventful recovery!
