Title: buisness question

who do I report to whne a company fails to pay their workers the correct min wage for cali my wife has been getting $20 a day and she works from 11.am to 10:30pmthats around $3 an hour, she has been asking to get a check so she can pay takes but the owner says she doesnt know how to do it. recently she has been threatened to get fired cause she asked a customer for her ID, the reason was the ladt always comes in sayings its someones Bday to get free ice cream so my wife just asked for her ID to show proof( same as military discount and senior discount I do it all the time) So the lady gets mad saying she never gets asked that everytime she comes in(everytime its someones Bday) and says shes a friend of the owner. Now she told the owner and the owner yelled at my wife saying if someone wants something for free give it to them(are we not in buisness to make money?) and also said my wife needs to smile more(for $3 an hour would you smile). I have told her to leave they are cheating her and it not correct buisness practice. who would I report this to? I know I should let it go but this is not the first time this crap happened and im done with it. the owner needs to learn she cant treat her employies like crap and also pay them nothing.

The minimum wage in CA is 8.50/hr I believe. This is enforced by several state organizations. Department of Labor

Hope you can find what you need. Call them tomorrow, they should be able to help, unless your wife is illegal they should be able to help, even so state of CA requires all people including house hold help to get paid a certain minimum wage.

Some states allow businesses to pay less than min wage to severs who are expected to get tips. Call the department of labor to get the specifics of your state.

shes not illegal, she has all her paperwork in order. I understand if she gets tips they make less but $20 for 11 hours thats not right. but thanks for the info.

11 hours a night? if she works more than 40 hours a week than she gets overtime too.

you can get paid less than min. wage if you get paid tips but that only applies to waiters, valet etc. doesn't count for if someone puts a tip jar next to the register.

I can't say for CA specifics, but here in PA I'm pretty sure even if someone is making $2.50 an hour and expecting tips, the employer still has to make sure they're hitting minimum wage, meaning if they only get $2.50 an hour in wages and $3 an hour in tips, their employer would have to kick in the extra until they hit the wage.

I wouldn't even have messed with them this long, I would've left as soon as I knew something goofy was going on. How much was she told she would be paid when she started? If she was supposed to get paid more than that it's not a matter of being paid less than minimum wage, it would be a matter of your employer just not paying you your earned wages, in which case you could probably just take them to court. Make sure she has the documentation of her hours worked though.

This is one more reason not to have tips. I would like to see a singapore style "no tipping" service industry. The whole garbage gets abused on all sides, people who take in tips dont report it, people claim you get tips and shaft their workers, and customers are "under pressure to tip". Seriously, it is a pita on all sides.

she didnt knoe she was getting screwed when they pay her. she gets around 25hours a week. I just told her to look around for a real job one that pays by the hour and when she does to just leave. My wife is thai and like working at thai resturants but all of them pay cash no one gets paid a check or pays taxes. I filled a complaint now ill let the take it over. I hope they get shut down. I even made a complaint with osha, the last time I used the restroom the restroom smelt like chemicals they have all their chemical right in front of the door where if a child uses the rest room they can mess with that stuff and since no one goes in that area no supervision is their.

3 bucks an hr is wrong at all levels
