i was leavng my house today on my ninja... which i had just finished painting and fixing up the day before. im about 5 minutes down my country road.
BAM car comes flying straight through the curve into their driveway.
she slowed down but didnt stop til i hit her car..
i knew it was either slide into it or hit it at speed.
slid into the car. bike is totaled. im semi ok. my left hip and knee are hurting.
police officer cited the other driver. said it was not my fault. he did not ticket her, but did cite her..
im shaken up as this was my first wreck on a bike ( had plenty on dirtbikes and the like) but never on the street)
wear your gear. make sure it fits, and is on right. every time!
im not a gear nazi. im not perfect. but something told me to wear my full lenght gloves today..

she didnt care that she almost ran over me. she was worried that my bike might have slid and scratched the front of her car.

Maybe take all ur receipt's of ur recent work since it was so recent and see about compensation for that too.

Did you hit her car? Unfortunately this may have helped you out. If there was a collision the officer would have had to write a ticket.
Anyways, the important thing is that you are okay. I had a collision on a the freeway no to long ago on my dual sport. It feels great just to be alive after something like that. Good job wearing your gear!
It irritates me that people could not give two shits about the bike they just destroyed with their careless driving and more importantly the rider on the bike, and Buddha Loves You about the scratches on her car. I mean yeah, if someone on a bike hit my car, and it was their fault, I might be a bit pissed, but I would still be more concerned about them and making sure they were ok before I worried about my paint.

Not sure about other states, but in California, an accident counts as a point on the driving record the same way a ticket does. I've been at fault twice, unfortunately, and never received a ticket. Still, my insurance rates went through the roof for a while, and was pretty close to losing my license.

Huh. Check your state laws. I'd still file an accident report with the police if one was not filed.
I'd then use that to take driver to court (small claims?) to receive either a) deductible (if insured) or b) total value of the bike, in addition to any medical expenses / deductables.
If that's too much work for you, call an accident attourney and have them do this for you. They take a 30-40% cut and your involvement is minimized. They'll go after the driver for you if they think there's enough there for a case.

she was cited, and in his report it clearly states she was at fault for failing to yield right of way. he just "warned her" instead of ticketing her. (prob cause she was blaming it on the tall grass that was blocking vision around the curve)
we called our ins right away and are gonna be getting everything in order asap. ive got receipts for everything ive done, and had on.

Go to a doctor! medical bills add up way faster than any gs500. She hit you, so her insurance should cover your medical bills and property. You aren't sore by choice.
+1 on the doctor. I was in a car accident in college and didn't feel too bad after. Unfortunately for me, the DC cops sent me to the hospital (who literally looked at me, said I'm fine, and sent me away) and didn't take down any of the woman's information (no one to press charges on). I was at a red light and she hit me from behind doing 60! No skid marks = she didn't even try to brake! A couple days later later my back and neck locked up and I was in bed for over a week. Never been the same since.
So yeah, now my back and neck are permanently messed up and give me trouble all the time, and I'm only 27, NOT 57. Go see a doctor and get EVERYTHING in writing. Best of luck to you and your bike.

Just out of curiosity .. Of those who have lost a bike. Did insurance cover your gear? And what all should I have in order besides the police accident report. (it has her ins company and stuff too)

If the other party is at fault, they are legally obligated to 'make you whole.' They are obligated to pay all actual losses, including medical, equipment, lost wages, etc. If you file a comp claim against your own provider, what's covered depends on the nature of your policy.

Lol. I somewhat agree. Most of my close calls were by the female side .. I'm just not sure I'm going to get what the bike is worth. Street value is over a thousand more than the kbb or NADA .. Similar models with similar models are going for over 3.2k.. Yet nada says 1700-2200... I'll be downright pisssssssed if I don't get atleast 3.

Nothing at all wrong with that...Around town I never wear gear except gloves and helmet (not even needed in PA). Long distance or commuting is always Jacket, Gloves, and Helmet. I love the freedom of the wind rushing past!!!
I see guys here in Houston everyday with no gear, not even a helmet and Houston traffic sucks shaZam! by the way. I saw a dude with a kid on the back both in shorts, get on the freeway in rush hour traffic this morning. I watched them get on the feeder and thought, 'don't get on,' and sure enough, he took the ramp onto the freeway. ack.

Your wrong. Plenty wrong is wrong with that scenario. The reality is that most accidents happen close to home, so when people say "im just running downtown" is when they are more likely to get into and accident. As in with this thread, his accident happened 5 mins from home. At least wear long pants, long shirt and gloves.

As far as north east Pa, as far back as I can recall, I only see less then Half of riders on the road wearing appropriate gear.
Its the kind of state that I heard took a long time back in the day to pass the helmet law.

I look in driver's windows when I'm in traffic, if I see it's a female driver, I gas it to get ahead. Both of my previous accidents were directly caused by the incompetence of the driver, which in both cases, was a female in her 30s.

Yes, face it women are worse drivers, not trying to be sexist but they are less aware of their surroundings, but trust me there are some horrible men drivers to! >:(

(Once rear ended while i was stopped, once head on while i was stopped)
(Once i, as a young man, thought i was a baja racer on dirt road, found a washed out part, flipped car over[we pushed it back over and kept going])
(Once i, as a young man, thought i could back up to a loading dock without really paying attention... hit a big rig (me in van) at about -20mph)
(Once i, as a young man, thought i could merge through snow into speeding traffic (one clear lane of 8lane highway) and i ended up under a big rig, from three different angles)
(Once i, as an older man, thought i could ride my bike cold, give little throttle and take off... laid bike over on a side road and luckily the lady in minivan behind me stopped before running me over).

I see posers all over the place here in AZ, especially now that the weather's warming up. In fact, I went riding with a friend of mine and he went without long sleeves, gloves, or a helmet. His excuse was, we're just going down the street. I told him that I enjoy having my skin ON my body and I'll be gearing up. Now, I'm not always faithful wearing riding pants, but I always at least wear long sleeves, long pants, gloves, boots, and helmet. Even if I've going less than a block away.

Also, my girl's sister could out ride most of you, 100% gauranteed. She has been riding since she was a kid and attends track days almost weekly since her husband is an instructor. She laps me, no problem. Plus she looks like my girl, slamming.

Some thoughts for getting what your bike is worth. I had a similar issue with a car my wife had a lot of custom work done on.
Get an appraisal of the bikes pre accident condition.
Get a quote for a used bike from a few dealers in your area, assuming you can find a bike of smiler condition.
Add the cost of any custom work ie the paint job if not the stock color to the quote from a dealer
add the cost of a new coat, and anything else that touched the ground.
Have your lawyer friend write a letter asking for that amount.
It worked for me but was a pain took a few months so might not be worth it for the money your talking about.
Hey Nicky Numbers they only time I say hey ride without gear is when you have insurance to cover your dumb a$$ when you wreck. If you at least got $25,000+ to cover you road rash, skin grafts, sprains and strains. The $25,000 grand probably wouldn't have even covered the OPs injuries had he not been wearing gear. As long as you can pay your hospital bill so that you are not putting a burden on the public then wear whatever you want. People in Florida say we are a helmet free choice that's not exactly true if you wreck and you don't have $25,000 insurance coverage the medical bills may just be on you weather or not the wreck was your fault. Since we are a no-fault state! I still don't get though why we are forced to wear seatbelts and not helmets though :dunno_black:
For the insurance you didn't actually hit the car did you? I will bet the world the insurance company is going to say since you laid the bike down that it was not the driver's fault. You lost controll before hitting her car. Your incompetence is not their problem they will say. This is another reason for not "laying it down" besides the fact that you can scrub off more speed than you would sliding down the road.
