In fact, there are a LOT of things that should never happen during a truthful negotiation and transaction (from http://gstwins.com/gsboard/index.php?topic=62173.0) which would include:

- a Seller (MTX Tires as represented by Tire Guy) taking 20 days to provide a Buyer with Tracking Numbers (let alone INVALID Tracking Numbers), especially when the Buyer submits a Request for Tracking Numbers a mere TEN days after the Invoice was Paid. (Yes, most reputable and respectable Sellers would have already delivered the merchandise by then.  This was my first interaction with a... disreputable seller);

- a Seller failing to even ATTEMPT to contact the Buyer that there is a financial shortfall in Shipping Costs FOUR WEEKS after the original Invoice is paid via PayPal.  I actually had to contact the Seller to find out why my merchandise had not been delivered (to a Neutral Third Party in Burlington, WA) nearly a month after I paid the Invoice;

- the continued failure by the Seller to provide the Buyer any estimates on the additional Shipping Costs.  I submitted a request to MTX Tires via E-Mail (so that there is recorded evidence with a Date/Time Stamp) for an estimate to cover the shortfall, a mere THREE DAYS after our telephone conversation (that I had to initiate).  By this time, SEVEN-AND-A-HALF WEEKS have passed since I paid the Invoice.

- the Seller finally responds with an estimate of Shipping Costs EIGHT WEEKS after he identifies that he had underestimated the Shipping Costs - TEN WEEKS after I paid the Invoice - and FAILS to acknowledge that I had Credit left over from the original amount I had paid for Shipping.

Incidentally, I pay the second Invoice that MTX Tires sends me ($217.00 USD) in good faith and under the assumption that the entirety of the original amount he had requested ($70.00 USD) had been completely used up in the shipment of the first of a total of three packages.

- THREE WEEKS after having paid the Second Invoice, and OVER THREE MONTHS after having paid the Original Invoice, I have to send MTX Tires yet another E-Mail asking them to identify which Delivery Company they were using as the parts I had paid for have STILL NOT BEEN DELIVERED, and the Tracking Numbers that they had provided are not recognized by Fed Ex, UPS or even the US Postal Service.

- two days later, another Rep from MTX Tires sends me an E-Mail admitting that MTX Tires had mailed my parts to the wrong customer (Are you kidding me?  Are you really that incompetent, or just that malicious with your lack of integrity?) but that they would be sending my parts back out in the mail once it gets returned to them

- four days after that E-Mail, I send MTX Tires a request to confirm the Shipping Address that they will mail my parts to and for them to provide New Tracking Numbers and identify which Delivery Company they will employ (as I now very much distrust their integrity and competence).  A total of FOUR WEEKS has passed since I had paid the Second Invoice, and OVER FOURTEEN WEEKS have passed since I paid the Original Invoice.

- TWO WEEKS after they admitted they mailed my parts to the wrong customer; approximately TEN DAYS after they inferred my parts should have been redirected; approximately FIVE-AND-A-HALF WEEKS after I paid the Second Invoice; and SIXTEEN WEEKS after I paid the Original Invoice... I have to send MTX Tires yet another E-Mail asking them to provide Tracking Numbers and the name of the Delivery Company as my parts HAVE STILL NOT BEEN DELIVERED.

Yes, that's a lot of E-Mails... because they would not accept my calls.  And E-Mails provide evidence of the Dates and Times that I tried to communicate with them.

So I contact PayPal and MasterCard (on 17 Feb 2013) to explain my dilemma, and both companies identify that I was reporting TOO LATE based on the date of my Original Transaction from 30 Oct 2012.

However, after persisting, and explaining that MTX Tires had failed to deliver my original transaction to a Third Party after paying a Second Invoice on 10 Jan 2013, they were able to initiate Disputes that were immediately escalated to Claims against MTX Tires.

Well THAT got the attention of MTX Tires.

They still never attempted to provide me with Tracking Numbers or identify the Delivery Company UNTIL AFTER the parts finally were delivered... a mere SEVEN CALENDAR DAYS from the Point of Origin.

Let me stress that again... SEVEN CALENDAR DAYS.

The final delivery of the merchandise I had paid for on 30 Oct 2012 was not concluded until 27 Feb 2013... FOUR MONTHS later.

And MTX Tires has the gall and audacity to send me an E-Mail to finally send me a breakdown of the Shipping Costs on 28 Feb 2013 with an offer to refund a mere $57.00 USD, and a statement that there was never any intent to keep any extra money left over, so there was no need for me to threaten action by filing a dispute with PayPal and MasterCard?

They made NO DISCERNIBLE EFFORT to honour their obligation to me UNTIL I filed a dispute with PayPal and MasterCard.

As far as I'm concerned, I should not be held liable for ANY of the $217.00 USD that I ended up paying on 10 Jan 2013, especially since the remainder of the motorcycle parts I had purchased were finally delivered AFTER the start of the 2013 Riding Season.  As of result of the timing of the final delivery of my parts, my motorcycle shop (the Neutral Third Party) will not be able to undertake the assembly of the 2004 parts onto my 2003 bike (it's Canadian.  The GS500E was produced in Canada in 2003 while not in the US) with the additional fabrication required for my 2003 frame until the END of the Riding Season, around Nov 2013.

Now, as I expect MTX Tires to continue to fail me in any manner of integrity, considering all the BULLSHIT they have put me through, I have filed a complaint against them with the Internet Crime Complaint Center (IC3) - www.ic3.gov.

The IC3 is co-sponsored by the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C). Complaints filed via this website are processed and may be referred to federal, state, local or international law enforcement or regulatory agencies for possible investigation.

And shortly after filing with the IC3, I contacted the local BBB.

Now, if you believe I am judging MTX Tires too harshly, after suffering their incompetence or maliciousness for FOUR MONTHS, please jump to their defence and enlighten me of my error.

Otherwise, the Buyer-Beware lessons to take away from this drama are these...

- PayPal and your Credit Card Company can only provide you Purchase Protection (under normal circumstances) over a period of 30 or 45 days.  Check with each one and be prepared to initiate any possible disputes BEFORE these periods expire.  At the very least, the Seller should provide you with VALID Tracking Numbers before this period expires;

- when in doubt, INITIATE the dispute.  It can always be cancelled; and,

- if the Seller repeatedly fails you (hopefully not as badly as MTX Tires had failed me)... do not let them off the hook.  Hold them to task and REPORT THEM to their local Better Business Bureau (http://www.bbb.org/); a local Consumer Protection Agency; and/or the Internet Crime Complaint Center.

If you do not act to protect yourself, disreputable Sellers will victimize others.

id have no beef with it staying either. couldnt read the blue text hardly. but you were detailed in your writeup. will give you props for that. i seem to remember the guys name from some other transaction i had ages ago. but cannot rememebr much. it as well wasnt pleasant. btw did they ask for their money back? ( curious) ( or the merchandise) some of the shady ppl will actually do this.

Actually, I'm not sure how this will all end.  But I doubt that MTX will have the time to ask for the parts back.  I suspect he will be hard pressed to demonstrate that he has been anything but a disreputable seller throughout the entire interaction between us.

Officially, my dispute with MTX Tires that was initiated and filed with MasterCard regarding the Original Invoice of $730.00 USD from 30 Oct 2012 for Failure to Deliver Merchandise Purchased is considered Closed as of 27 Feb 2013.  MTX Tires finally shipped/delivered the merchandise I had purchased and effectively renders that dispute moot.  However, I ensured to provide MasterCard with a letter with a brief synopsis of the events of the timeline as listed previously; and advised them that I may require their assistance for follow up action pending the ruling on my second dispute using a second MasterCard from a different Financial Institution.

My dispute initiated with PayPal for the Second Invoice of $217.00 USD to cover the additional Shipping Charges had also originally been registered under Failure to Deliver and was originally Closed by PayPal when my parts had been delivered.  Fortunately, MTX Tires had provided a Financial Breakdown of the Shipping Costs, which showed that I am actually due a refund so I appealed PayPal's decision and changed my Claim reason to "Not as Described".  I made sure to identify how MTX Tires had failed repeatedly to provide me with estimates of Shipping Costs after multiple requests, and that I believe that I should be reimbursed a MINIMUM of HALF the $217.00 USD paid (at least $108.50 USD) if not the ENTIRE AMOUNT as a result of their uncooperativeness throughout the entire venture.  The case is currently Open and awaiting a response from MTX Tires.

As part of my communique with PayPal's Complaint Department, they had recommended that I consider filing a separate claim to the Internet Crime Complaint Center (IC3) for my Original Invoice of $730.00 USD as PayPal's hands were technically tied due to the fact that I began the Dispute Process AFTER the Statute of Limitations of 45 days for Consumer Purchase Protection had expired.

Technically, I no longer have grounds for a claim on the $730.00 USD Invoice as a whole; however, I DO have a case in that the $730.00 USD was the combined amount for $660.00 USD for the parts and $70.00 USD for the initial estimate of Shipping.  When combined with the additional $217.00 USD Invoice from 10 Jan 2013, MTX Tires has effectively charged me a total of $287.00 USD for Shipping, but there is evidence that this is an excessive amount.  And thanks to UPS Online, and the shipping labels from the boxes of my delivered parts, there may be sufficient evidence to show that MTX Tires may have tried to provide estimates of Shipping Costs using falsified weights for my packages.

Now, while completing the online submission to the IC3, part of the process asked if I had contacted any other agencies including the Better Business Bureau (BBB) and a Consumer Protection Agency within the local area of the business.  So, as soon as I completed my submission to the IC3, I initiated my next Dispute filing with the BBB.

For both the IC3 and BBB submissions (submitted on Friday, 8 Mar 2013), I argued that I do not believe I should be held financially liable for any of the $217.00 USD that I had paid via PayPal as a result of MTX Tires failure to act in a timely or appropriate manner throughout the entire transaction, and that I believe I should be entitled to a reimbursement of the full amount.

Now, depending on how many good karma points MTX Tires may or may not have, this weekend may be one of the last relatively peaceful ones he will experience before the IC3 and BBB begin investigating his business.  And unlike 17 Feb 2013, when I gave MTX Tires notice that I was officially initiating a dispute via PayPal and that he would have 10 or 12 days to respond, I am under no obligation whatsoever to give him notice that I have contacted the IC3 or the BBB; and those investigations will be on top of his requirement to respond to the PayPal Appeal case that is currently Open and will be decided upon by 16 Mar 2013.

But as things stand as of 9 Mar 2013, I do not know if:
- MTX Tires will voluntarily refund the full $217.00 USD;
- MTX Tires will only voluntarily refund the $57.00 USD they had offered;
- PayPal will force MTX Tires to refund HALF the $217.00 USD ($108.50 USD); or,
- if PayPal (with or without influence under the IC3 and/or the BBB) will force MTX Tires to refund the entire $217.00 USD.

Granted, when you take into consideration that I am not the first person MTX Tires has tried to screw over, I can be content with not receiving reimbursement of any amount of my $217.00 USD if I know that MTX Tires effectively loses his business license as a result of investigations into his operational practices by PayPal; the IC3; the BBB or any combination of those organizations.

No matter how this ends, disputes have been officially filed against MTX Tires to different agencies on multiple fronts so he'll either learn from this mistake and become a better Seller, or he'll hopefully lose his business license so that he cannot victimize anyone else... but I really would like to get my $217.00 USD back.  An ethical victory on principal alone would feel hollow if he is able to keep my money.

This is the one of the best forms of action you can take. Posting this on a popular forum is bad advertising for him. make sure you let him know about it and maybe email him a link to this thread. I know on other forums this has given slack sellers a good kick on the as$....

Why i always google a bushiness and check with bbb etc about any business/company i have never bought from. Little research can save you big time.

I was going to buy some parts that where really price cheaped compared to other companys, googled the name and flooded with complaints. Needless to say i did not buy from them. One reason i use ebay a lot, ebay can get your money back a lot more easy then paypal, credit cards.

Unfortunately, PayPal is content to close the case as MTX Tires finally delivered my purchase FOUR MONTHS after I made my initial payment.  And PayPal has chosen to take NO action to force MTX Tires to at least reimburse the $57.00 that (MTX Tires) has claimed that they over charged me.

I don't know if I should hold out any hope for the Internet Crime Complaint Center or the Better Business Bureau of the Greater New Orleans Area to actually take any action.

So I guess the moral of the story for Buyers is to make sure that Sellers explicitly detail all Shipping Costs before committing any funds; then only give the Seller ONE WEEK to provide Valid Tracking Numbers before INITIATING a PayPal Complaint to make sure that the Seller doesn't get the opportunity to take advantage of you.

Yes indeed. to the OP i must admit. that sir is a DETAILED writeup. hmmm youtube maybe? lol. takes ages to get new customers, yet moments to lose them. You lose 1, they tend to take a few more with them, and so  on so forth.

I haven't heard from the Internet Crime Complaint Centre yet, but the Better Business Bureau of New Orleans has been in contact with me, so I haven't lost ALL hope that something will be done.

I can't say for certain that I will get any of my money back, but I'll be satisfied if this guys reputation takes a big hit, other potential buyers are warded off, and he loses customers.
