Right, they can be legally.  I was saying it's unlucky because if you look at the report both the driver and the owner are the guy.  I guess he lives at home so that's how the mother was contacted.

Yeah...the driver's over 21, and the car's in his name only... His parents aren't likely liable for anything.  I wonder what the cops are going to do to him... I hope they throw the book at him!

Not really, I am right: it does say that he was riding a Suziki. It says later that it was a Suzuki, but my point remains. So saying it doesn't say that is incorrect. I am the champion of the interwebs!

I'd HIGHLY recommend getting an attorney,.  Makes the process much easier and will let him know you're serious.  Also can go for Fees if you go District Court instead of Small Claims ... might be worth it.

UPDATE:

I had talked to a customer who comes in to where I work.  He used to be an Assistant District Attorney.  He recommended that I talk to the D.A. to find out if I can get some restitution when the D.A. charges him with the crimes.

I also got the quote for repairs from the local guy.  It came up to a little more than $2200.  That includes the minor scratches on the end of the exhaust.  Did you know that the exhaust system from the dealer is a little more than $1050???  Holy Shite!!!

I'm happy though.

I went to the police station again today, and they gave me an updated copy of the police report.

The new report has the citation and violations listed.

I'm trying to search for the details of the violation online, but they're most likely hit & run, and operating a m/v without insurance.

I think you just get a simple "I won, you lost....so ha!" Good luck getting anything if they have nothing, it will take them forever to pay. I'm not sure of this whole  situation with my parents, both grandparents, aunts, uncles, and many other people. But this guy sends us a check every once in a while for like 2 bucks, to help pay back the thousands and thousands of dollars he stole. We know we won't get it all back.

I believe that Small Claims Court is the "I win, you lose".  If I were to take the jerk to small claims, when I win, he still could NOT pay me.  At that point, I'd have to bring him to court AGAIN.

With a lawsuit, if I took that route, when I won, he would have to pay within a certain time and something like small payents or something.
