Motorcycle Accident

Blast

I had to slow down for a bus and finally stop because it was making a turn.
When suddenly I was hit from the rear, I didn't see it coming.
I was hit so hard that my bike flew forwards then fell on its side then I sat on the engine a rode it like I was surfing with sparks flying all around.
When I stopped sliding, I looked back and saw another bike on the ground.

This guy had a brand used  R6.
He slid on the ground. He was not wearing any protection.
He was like "Lets not call the cops and exchange insurance information".

The cops where there before I could even take my helmet off.
They made a report, this dude had no license and no insurance.

His bike hit me on my left ass cheek and made it all purple and my lower back hurt.

I took my bike to the local dealer and they made a $2000 estimate that included a new exhaust pipe,
swing arm, front and rear fairings mirror +more!
The bike is there for 3 months, they cant seem to get parts for it. I didnt know there was a red 06. They got red fairings! Something about the bike is made in spain and that Suzuki has a wack parts system for that bike.

Then they said that they are not going to replace my exhaust pipe, just re-skin it and paint it.
After three months i wrecked my car to some freeway debris and needed my bike, so I told them I needed it. And of a sudden they have my parts!

They got it ready for me. All I had to do was come back on sat to get my pipe re-skinned.
I got it home saw that the rear wheel splash guard was loose, its held on by two bolts but one was missing and the other one was on by one tread. Also the tool kit tie down was missing and the tool kit was filled with water.

I put it together with some Volvo hardware.
But im riding it everyday now 80miles a day and I love it!

Im afraid to take the bike back there.
Maybe ill just get some after market exhaust when I can afford one.

Is that B&W beemer in the last shot a police bike? If so friggen awesome cop ride.

Sounds like the kinda guy to have a collection of FTP shirts and a habit of running when he see's red and blues.
Why didn't you just go the whole way and buy me a f@#king Kawasaki you bastards.

Raydr

That first picture makes me want to cry.

makenzie71

it's a good thing that R6 was wearing a helmet!

baco99

the R6 rider sounds like a real idiot to me.

glad you were OK and back on the road.

blue05twin

Glad your ok.
always get a police report if your in accident ( I know he did but thats for anyone else out there that gets into an accident and the other person tries to talk you out of it (
Pilot 22.5, Mid 65 , Mains 147.5, Mixture screw 3.5 turns out

Even if the voices aren't real they have some good ideas.

Always get a police report if your in accident!!!!

Glad you were ok, Blast. The following is just a story, not a cut against you. That a@@hole was trying to pull a fast one on you.

My Bro-in law rearended a freindly lil' lady with children in her car. She convinced him to not get a police report, and file with insur.

She even gave him a lift to work, because she ruined his car. See it was her fault.  She pulled out in front of him, he was in the right. He wasn't speeding or nothing. She pulled out so suddenly, he didn't even leave skidmarks.

A police report would have shown this.

This nice lil' ladies insur is suing him for the damage of HER car. 10K+!!!!!!   Since the damage was to her rear and the was no police report to back him up, the insur faulted him.

Always get a police report if your in accident!!!! even if you're at fault.

Actually, if you're brother in law hit the back of the lady's car, he is 100% at fault in the eyes of the law...and, really, in the eyes of common sense.  If someone is stopped as if to enter your lane of travel you are to act as though they will pull out there at any minute.  This is why, in such a situation, you either floor it to make sure you t-bone their car, or slow down enough to make sure you have a lot of room and time to stop.

In every state in the US; You hit, your fault.  You weren't allowing safe distance between your car and traffic.

s4gs

Glad you not seriously hurt but go to the doc. & get checked out anyway.
And like FearedGS500 said, find another dealer. What the hell is with the water in the tool kit :o

ACTUALLY, a rearender is always at fault in the eyes of the law. I've heard that one. Just like innocent until proven quilty.   In this case, however, with the pictures of the crash site and vehicles every cop and lawyer he has shown it to agrees that the police report would have saved him from a lawsuit.

With a police report this would have never went past the insurance agencies.

The problem is the pictures were not taken at the day of the accident. There is no police report to back him up. He is up shaZam! creek. With a broken paddle. He will have to argue his case in front of a judge. I have seen the pics and I was at the scene to help tow his car.  She was definitely at fault. Now he is at the mercy of the judge.

I bite my thumb at your "eyes of common sense" ill-logic. On a bike I "act" as if they will pull out, but you have to be farking kidding me to say you actually believe the person pulling out cannot EVER be at fault "in the eyes of common sense".

So are you saying "every" biker that has died from someone pulling out in front of them, died of their own lack of common sense?

QuoteActually, if you're brother in law hit the back of the lady's car, he is 100% at fault in the eyes of the law...and, really, in the eyes of common sense.
Regardless of how cautious or prepared the driver is, it is entirely possible for someone to misjudge your speed and reaction time or even to just not care and jump out at the last minute. In my bro in laws case he hit the left rear bumper. The lady had to make a fast sharp right turn to avoid striking vehicles in the lane left of which he was driving. She jumped out and jerked right so hard he didn't even have time to react.

Yeah, we could be lying but we could be telling the truth. Saying that "common sense" tells us the rearender is always 100% at fault is wrong.
I would agree that most rearenders are at fault but you have to admit sometimes the rearendee is at fault.
Semantics, I know, but oh well.

Where are you getting your "common sense" from?  See if they will give you a refund.

I can't think of a single situation under which the "rearendee" is at fault.  And yeah, every motorcyclist who's died as a result of hitting something was at fault. You're welcome to provide examples to prove me wrong, but you will not be able to.

3imo

ACTUALLY, I could if I wanted to. I won't waste my time looking for a case to prove my point. I don't need to. I know it's possible.  8)

Even dumb criminals know it is possible. It is a known fact that people defraud insurance companies by "making" someone rearend them. Ask Allstate. If someone intentionally made "you" rearend them, are you at fault? :icon_confused:

They are playing on the "Fact" that the rearender is at fault. A "fact" that you wholeheartedly believe and hold onto. Many people are quick to pass judgement on things they know nothing about or have never experienced firsthand.

It's a shame you won't even consider the possiblity. But I don't care anyway.  :dunno_white:

Glad things worked out for ya', Blast. I'd say that that first pic makes me cry, but that's often how my bike looks. ;)

+1 on always getting a police report and going through insurance. I've heard so many stories of folks begging others not to go through insurance and then turning around and trying to ream them.... I don't care how many tears they cry; if I'm in an accident with someone, I'll be calling my insurance company from the scene of the accident.  :thumb:

Make that "in North America" -- You hit, your fault. Every province in Canada has the same rule.

Hey thanks for all the replies. You guys are awesome.
Yeah that the cops bike in the back round.
The accident  was in Azusa on Azusa.
I was heading up to the canyons.

We should go sometime.

This sunday some guys from work are going to ride up Ortega highway.http://www.northcountycruisers.com/ortegatrip.html
One duck said that my bike cant keep up with them.
I think its does all right especially with all the curves. Lets go!
Ill be able to use my helmet cam.http://digicam.ru/images/news/2005/10/12/archos1.jpg
I hook it to my helmet using two suction cups I got from Ebay. It works nicely.
I never use it. Its kind of a hassle sometimes.

All I need to do is hook up the 12V accessory adapter because the archos battery lasts like two hours.

Check out his shoe!
I need to buy some riding boots!

good judgement trumps good skills every time.

What is the brand name of this camera...how much was it...and do the suction cups really work?
