Plus when she does if she does pay the loan off. She still doesnt have to transfer nothing over to me...She really doesnt...SINCE she's the person the title gets made to. Not me being the intended buyer. She doesnt have the money NOR the credit to pay off the *payoff* amount of the balance...and THUS needs my monies to complete the payoff.

so YEAH like I dont want to be ripped off...she owes on the bike. But without a clean and clear title this is turning out to be a huge headache..ughh!!

EVEN if i pay her the money, and SHE GIVES ME BIKE TO TRUCK out to my place. She can keep the cash, let suzuki repo the bike and I could be up the river with NO BIKE and ALL MY CASH long gone....

so yeah, i dont want to end up on judge judy or something.

WHAT TO DO?? WHAT DO TOO?? legally, and carefully without the headache or rise of possibly being ripped off. :(

my suggestion is to:

1) talk to the chick and see if she'll cooperate with you by placing a conference call to the lienholder.
2) find out exactly, down to the penny, how much the payoff amount is
3) you cut a cashier check for $3900 to the lienholder
4) have the chica cut the remaining balance (if there is any) in a cashier check to the lienholder
5) meet with her at a local payment location to hand in your cashier checks simultaneously
6) have her fill out and sign the bill of sale at that moment
7) provide your name and address to the lienholder so they can mail the pink slip directly to you
8) receive your pink in whatever time the lienholder agrees to (usually about 30 days, but they'll probably tell you 1-2 weeks)
9) bring the pink back to the seller for final signature
10) head out to dmv to take care of the rest

i think that's the path of least resistance and would minimize the amount of calling, driving, and meeting up with a bunch of odd folks to close a deal. i would've done it this way if i knew how it was going to go down. good luck, dude. hope you get the bike. it's a sweet bike for a killer deal.

Already talked to suzuki DIRECLY LONG AGO.... no can do. I could get a cashiers check and go with her and all the stuff as you mentioned. BUT they will not add me to her account at all, nor will they cut the title to my name even if I plan on buying such bike. They only cut the title to the account holder and that IS her...NO MATTER what.

Like i said before, even IF i send my check in, or to a payment center. Who's to say after they give her the title she will transfer the bike over to me. NOBODY. She can absolutely change her mind and keep the bike and the money I gave her. Not good...(avoids any risk)

there's no need to add you to her account and the pink slip doesn't get "cut" to anyone. right now, the pink slip is held by the lienholder, not the missus. the pink slip will indicate the title owner's name (ms. afraid-to-ride-chica) as well as the lienholder's company name. once paid off, the pink slip NEEDS to go to someone. that someone could be you or it could be her. it doesn't matter. whether you get it in the mail or she gets it in her mail, she needs to sign the pink and hand it to you. it's useless to her.

why?

Used vehicle sales, like this occur, everyday. You just have to evaluate the seller. If they seem shady, cover all of your tracks. Most likely, if something were to happen, as long as you have a written receipt, it would hold up in any court.

actually got fixed under an authorized dealership, specifically at southland cycle(only work on suzuki's) in garden grove by the mechanic ed who had 25 years under his belt.

anyone who needs work done, i recommend him greatly. Good guy, and honest.
