even if you are passing on the right, its still the cars fault for failing to yeild.

no matter what anybody is ever doing, if you are changing  lanes, you have to yeild. end of story.

Doesn't sound like it was a lane change.  Passing on the right is illegal in most if not every state.  It could have been that the cage was slowing without signaling (or even put on the wrong signal) and Clooney attempted to pass on the right.

Either way, no matter whose "fault," the motorcyclist always pays a greater price!
