New laws have Bikies facing extra 25 years in jail

CRIMINAL bikie gang members who are found guilty of an offence face spending up to an additional 25 years behind bars under proposed new laws introduced into State Parliament today.

Attorney-General Jarrod Bleijie has detailed the government's plans to destroy criminal bikie gangs in the state, outlining three new pieces of legislation, saying the tough response would make Queensland's streets safer.

"We are sending a loud and clear message to criminal motorcycle gangs and other criminal organisations that their illegal and violent activities will not be tolerated," Mr Bleijie said.

Under the new Vicious Association Disestablishment Bill, gang members who engaged in serious criminal activity would face 15 years of mandatory extra jail time, on top of sentences already received for original offences.

If the member is an office bearer, they will receive an additional 25 years on top of their initial sentence.

"Under our Vicious Lawless Association Disestablishment Bill, criminal gang members convicted of certain offences will be declared 'vicious lawless associates' and hit with an extra 15 years mandatory jail time on top of their sentence.

"A further mandatory term of 10 years will apply if the offender is an office bearer of the criminal organisation," Mr Bleijie said.

In total, three new pieces of legislation were introduced to State Parliament, including the Tattoo Parlours Bill and the Criminal Law Criminal Gangs Destruction Amendment Bill.

"Tattoo parlours will also require licenses from next year. Current and prospective proprietors will need to be fit and proper persons and will undergo police checks before their application is approved.

"The punishment is deliberately and unapologetically severe because we want to break the bikies - break their enterprise, break their spirit, break up their groups."

Mr Bleijie said three new offences, specifically targeting criminal gangs, would also be created.

The new offences include; Knowingly gathering in groups of three or more members in a public place (including riding); Going to banned locations (e.g. clubhouses) and Promoting or recruiting for the organisation.

"These new offences will carry mandatory six month jail terms, with a maximum of three years in prison," Mr Bleijie said.

"We are also increasing penalties for existing offences if they are committed by criminal motorcycle gang members."

Increased penalties include a Mandatory one year prison sentence for serious assault of a police officer.

A mandatory six months in prison for affray with the maximum penalty increased from one year to seven years and an $11,000 fine (double the current penalty) and disqualified license for two years for evading police.

Mr Bleijie said the reforms would also strengthen Queensland's crime fighting bodies and courts.

"We will give the Crime and Misconduct Commission unprecedented powers to haul in CMG members and question them for intelligence gathering purposes. If members don't co-operate, they face mandatory jail time," Mr Bleijie said.

"The cone of silence these gangs employ when questioned will soon work against them.

"If they don't answer questions during coercive hearings by the Crime and Misconduct Commission, they face mandatory jail time for contempt. If they refuse again, they get more jail time."

Mandatory jail terms for contempt are at the discretion of the Supreme Court for the first offence, however the second offence carries a mandatory sentence of two-and-a-half years and five-years for the third offence.

"Criminal motorcycle gang members also face losing their pride and joy," Mr Bleijie said.

"If a member uses his bike immediately before, during or after committing many of these offences, we will confiscate it and crush it. Without his bike, he's just another thug.

"Other vehicles used by gangs will also be able to be confiscated and crushed under the reforms.

"These new and increased penalties will apply only to criminal gang members. Law abiding motorbike riders have nothing to worry about.

"The Queensland community demanded and deserves a tough response to the violence and intimidation of these groups and the best way we can achieve that is to get their members off the streets."

A BIKIE-only prison facility where gang members are denied gym facilities and televisions, is to be established by the Newman Government.

Convicted gang members imprisoned at the facility, to be established at the ultra-secure Woodford Correctional Centre, will be kept in their cells for up to 23 hours a day and subject to more stringent drug tests and searches.

All calls unrelated to their legal representation will be monitored and their mail opened and censored while visitor contact will be restricted to one hour a week.

Bikie members already in Queensland prisons will also be transferred to the new facility.

The bikie gang-only facility, likely to draw comparisons from critics with Guantanamo Bay, is aimed at denying them the ability to use prison time to recruit new members and widen their drug networks.

Premier Campbell Newman said the facility would form the core of his government's commitment to get criminal motorcycle gang members off Queensland streets.

"We will use a maximum security facility at Woodford Correctional Centre to incarcerate these thugs," Mr Newman said.

"Consideration will also be given to recommissioning currently unused maximum security units at other prisons across Queensland."

Attorney-General Jarrod Bleijie said a bikies-only facility would thwart their ability to use prison time as a recruitment drive and business-development opportunity.

"These criminals use their time in prison to recruit new members and continue criminal activities including the distribution of drugs and intimidation of prison staff," Mr Bleijie said.

Establishing the facility will be an integral part of sweeping legislation to be introduced and passed through State Parliament this week.

The new laws will also automatically ban bikies from accessing bail and hand greater investigative powers to the Crime and Misconduct Commission.

Civil libertarians and members of the legal fraternity have condemned the proposed bikie crackdown as unnecessary, ill-conceived and arrogant, claiming it was a return to Bjelke-Petersen era law and order policy.

However, Mr Newman said the Government was determined to ensure violent criminals faced stiff penalties.

"They will do hard time and I make no apologies for that," he said.

Mr Bleijie said they were also considering tougher penalties for crimes committed in prison, including weapon offences, assaults and drug use.

Penalties will also be tough for prison staff caught colluding with gang members.

The problem is that they're way out of line... so many of those "laws" are going to get challenged in court based on civil liberties etc. and get thrown out... the bikies can afford top lawyers for that stuff.

Us innocent true riders will be the ones getting hassled constantly and probably fined for minor useless crap just so they can justify the fact we got pulled over.

Already the government has admitted social riders will be impacted *and* have also admitted that some cases will be thrown out of court... so why rush through this crap without all the checks and balances? Did Jo get raised from the grave in the form of Newman and/or Bleije? I might like '80's bikes but I don't want to live with the corrupt '80's pollies!!!!

There have also been reports of legitimate riders on toy rides being harassed and those are the sorts of rides that will be impacted by these laws...

They also don't seem to have twigged to the fact that in a lot of cases, it's bikie gang *associates* that are causing the ruckus, not bikies... associates don't ride and don't care about riding... so again these laws against motorcyclists only are so useless and therefore even more discriminatory...
