Advice on dealing with Scammers

First off, Not a GSTwin issue, actually an SVRider one.  All my dealings with people here have been great!
My girlfriend got hosed.  The gas tank on her SV was damaged from the first owner, so she went to replace it.  Guy from SVRider offered her a gas tank from PA, couldn't see it first.  She bought it for $200.  Arrives, it is worse than the one she already had.  It was patched with fiberglass that was expoxied on.  It had bubbles in the paint that were no visible in photographs and was rusted all to heck inside.  The tank is literally splitting in half.  She e-mailed him explaining that this was obviously unacceptable.  His response, tough, sold as is.  Paypal won't help because they only resolve issues of non-delivery.  
So, we are going to post photos of this beautiful tank on SVRider warning people.  Any other suggestions on finding a way to get $$$.  Revenge isn't worth it.  The guy is an ass, just want to post pics to warn others about him.  We are now buying an OEM tank, don't want to deal with any more issues or scams...

That sucks man. I went there looking for an Sv650 chainguard, and I found 2 dudes who were willing to sell it to me for $5 shipped. You found a bad one there. I don't have any suggestions on get-back for that. But everyone here is really good to each other, so I'm sure you will get someone to help you.

Giving the guy some benefit of the doubt, I have no doubts his other parts are fine.  A gas tank is a tough one, though.  A little rust on another part, no big deal.  But this gas tank is horrid....  Well, we learn the hard way some times....

about the only thing you can do is publicly flame him on the sv board. put up lots of pics of the tank, and see if his attidude changes.

If the guy misrepresented the item, saying it was perfect, then it's fraud...  You can take him to small claims court for the money...  That's about it. :dunno:

The part was sold across state lines and is worth under $200.... which means that if the scammer fights you at ALL then you're going to end up spending more money than you spent on the tank.


I would do this.  If you have a friend that is a lawyer, or know of a lawyer that is willing to help you out for cheap....   document the state of the tank with LOTS of high res photos, have it looked at by a mechanic to get expert opinion on the condition, collect all your correspondence with the scammer and then have your lawyer buddy send a letter to him with your complaint, and a request for an immediate refund.  Next, I would get all the other data that you compiled and send copies to the appropriate local law enforcement arms, and whatever federal bureacracy deals with interstate commerce.

Next, check on how much it will cost to file in small claims court.  

Hopefully, the guy will realize that the potential red-tape and long-term hassle of having to deal with his scam probably isn't worth the $200 he scammed from you (esp if he can just get !$50 for it without cheating someone).

I bet if you had a "lawyer friend" send him a notice on legal-letterhead documenting some state laws regarding fraud, poor selling practices, stuff like that, it might spook him into making things right. You never know.  :lol:  :dunno:
