my friend jus got arrested for domestic violence thing is he didnt even touch anyone...  :o apparently if ur arguing with a family menber and u start breakin ur own stuff u can be arrested, wutta hell is it just me or does that sound stupid as s&*t??? if im pissed and i wanna break my own shaZam! i should be allowed to do so. :guns: any thoughts???

Thoughts? um, yea. They all fall on the other side of your thoughts though.
So, short version: shaZam! happens. people get scared. people that are scared expect cops to do something. comming over and saying, "stop it" doesnt cut it most of the time that they are needed.
Signatures are displayed at the bottom of each BIKE or personal message. BBC code and WORKS may be used in your WELL.

While I agree that you should be able to break your own stuff (making sure that you really are breaking only your own stuff), the law in most places is set up so that if the cops do get called for domestic violence, they have to arrest someone.  It may seem silly in your situation, but the the law is the way it is to protect battered women.  So the cops can't show up, and have the scared and abused wife/girlfriend call the cops off ("No, it's all right.  He loves me, really.) only to be abused further.

And 99% of the time it's the guy going to jail...  (Even though it's the guy being the agressor like 85% of the time).

That other 1% is when the guy is smart enough to let his woman stab him without defending himself...  Then call the cops and hide in a locked room...  THEN the woman attacks the cops when they show up...

Other than that...  It's the guy going to jail no matter who did what.  :dunno:

I'm not a lawyer but I have some familiarity with this issue due to a friend and her boyfriend.

Smashing things while threatening someone can be part of charge of "communicating threats". In all the places I know of you aren't charged with "domestic violence" but rather "assault" or something similar if physical contact is involved. If there is no evidence or testimony of contact then things get less clear.

Like others have said , if the cops show up on a call like that they usually take someone away. In other words they are placed under arrest but may not later be charged with anything. Depending on local laws, you might be charged with "disturbing the peace" if breaking your own shaZam! caused your neighbors to call 911.

What was the specific charge? Sounds like he might need a lawyer and an anger management class.

I think the law is BS. Women who stay in abuse relationships are just plain stupid. There is no reason for it anymore, and there is no reason for society or our laws to cater to them. There are safe houses, government programs, and laws to protect battered women. And before I get too much guff, let me state that while growing up my mother was in TWO abusive relationships. We lived in a batterned women and children shelter for a while. So I can sort of understand where battered women and children come from. Hence the reason I don't think the man should be arrested for domestic violence for yelling or breaking things. Distubring the peace, perhaps. But no one should have to walk on egg shells or have presumed guilt, either. This is supposed to be a free country, and you should be innocent until proven guilty.

I don't think the guy is right for yelling / breaking shaZam!. He sounds like an @$$hole. But it isn't against the law to be an @$$hole. If it were, a lot of us including myself would be in a lot of trouble.   :P

I think your friend / brother / whatever he is should get a lawyer and try to have this dropped if he takes anger management counseling and stays away from the woman.

Personally, I'm pretty level headed so I can't think of a time when I really went off the deep end like this. That's when you just walk out say say:  :nana:

Frequently, males who abuse isolate their wives/girlfriends from their family, friends, etc, and don't "allow" the woman to work outside the home. She's completely dependent on him, and her self esteem is also often in tatters. It takes an incredibly strong and brave woman to pack up and leave; it's scarier to head out for the unknown with absolutely no idea of how you'll eat than it is to stay in the known, even if that means being beaten/abused.

The only place I have a hard time is when I hear that there are children being abused. I would die before I'd let my child suffer at the hands of anyone. Unfortunately, the women are often so beaten down that they feel powerless, even though their children are in danger, too.

If a man OR a woman is yelling, threatening, throwing things, and/or basically out of control, I think they SHOULD be arrested. If we want the benefits of freedom, we need to control ourselves. I wonder if the guy threw any of his things at or near his girlfriend.

Battery is when physical contact is involved.  Assault is threats of physical violence, which can include smashing stuff.

Anger management - and read the laws.  Ignorance of 'em doesn't cut it...
