Bike tipped...need legal advice please..!!!

  And on the sweetest January day too.  Anyhow this is what happened:

  Parked my bike at one of it's usual spots in the city after arriving at work at a corner with about 20 feet of space from the next car behind me thanks to a fire hydrant.  Later in the day a moving truck from Flatrate moving squeezed into that space to do a move leaving literally inches between the front of the truck and the bike.  When they were done they pulled out tipped my bike doing damage to it, stood it up again and then drove off.  The witnesses were restaurant employees that were about 15' from my bike.  I already called the moving company who's dispatcher told me they would "try" to find who was driving that truck and contact me.

  That was late today and their office is closed.  I was able to ride home but without a footpeg or rear brake as the assembly that holds all that in place was literally broken off.

  Now for the question:  Is there anything i can do to hold these guys liable..??   :2guns: :2guns: :2guns: :2guns: :2guns: :2guns:

It's been a rough day.  Last week i found my bike on the sidewalk after "someone moved it there" from the street for no apparent reason.  And it had a disc lock on it.  Welcome to New York City.  :flipoff: :flipoff: :flipoff:

right extremely obscene post its and leave them on your bike.  people will think you're crazy and wont f%$k with your bike.

Call the cops, threaten to press charges against the moving company unless they pay for your damages. You have witnesses that can back your story. They should throw up a hefty chunk of change for you, and if you can fix it yourself you can have money left over for mods.

yeah A police report would have been good....
Also get your witnesses info and I'd still call a cop and get some kind of report filed....

Agreed... when companies see the police involved and possible civil as well as criminal charges... (they left the scene) they'll throw up some bucks to get you out of their hair!

Be loud... make it sound like you're ready to call the supreme court.... they'll fix it and them some

yeah, call in a police report and make sure its a hit-and-run, seeing as how they left it there, damaged. get witness info to the police too. then WRITE the company, reiterating who you talked to that first call/day and what they said. Nothing scares people like a paper trail.

If the police don't have it on record they can tell you anything.
Make sure the police report mentions the witness or get a signed statement from them.  People move and in a few weeks you might have a wintess.

always have a police report before you even move the bike. if its still laying on the ground when you get there, if its not leaking fuel creating a safety issue then leave it there for picture documentation.

Bring a law suit in small claims court against the moving company for the damages.  Use the recepits from new parts for exhibits and any demand letter you did to the company.  Call the restaurant employees that witnessed it and see if they'll come testify for you.
