I was laying in bed this morning half asleep and listening to Mark & Brian on the radio and heard this lady call in saying she hit a motorcyclist on the freeway a couple of months ago. Woke up at that point and listen more carefully. Turns out she made a turn into someone who was lane splitting and put him in the hospital for the last month. I didn't rush to record because I time shift my radio live through my computer and was able to go back and pull the entire thing after.

Listen here.

Considering I have to lane split every day, the whole call peaked my interest. What do ya think? Sound to me like it was completely her fault.

Seriously, I was SCREAMING this when I was listening to it this morning. Pissed me off good enough to try and call. I'm voting for the death penalty in this situation and I don't even believe in the death penalty. :thumb:

I don't think we have enough information to know who was at fault, and it doesn't take a whole lot of speed to create severe injuries. If you figure traffic moving at 5mpg and the biker within 10mph of traffic and all of a sudden a truck blocks the entire lane you've got 15mph to dead stop in a very short period of time. On the converse, he could have been speeding and she could have adequately checked and just not seen him so far back.

The thing that irks me, however, is the way she wants to present the information as though the biker were at fault, assuming that if she got witnesses that they'd be on her side for some reason.  I guess its natural human tendency to retell the truth with personal bias filtered in, but we all heard how she tried to distort things. "he didn't even have a scrape..." "they took him away in an ambulance just as a precaution." etc. This guy ended up in the hospital for a while and that is definitely not something they do as a simple precaution. Lane splitting is a legal, but risky maneuver and shouldn't be done without knowingly accepting that level of risk.

What a dumb Buddha Loves You. I dont care who is at fault its the fact she said he didnt have a scratch on him, he seemed fine. If he was so fine, why right after were you holding his hand when he was laying on the ground, if he was so fine why was he taken to the hospital cuz he was in so much pain. Dont try to paint the picture like he popped right up and was doing jumping jax after, the guy was pretty obviously f%&ked up. I take it very personally when someone in another vehicles cuts me off or what not, they treat it as "oops!" sorry and wave. I take it as, hey this is my life you almost took, I only have one, "oops" aint gonna cut it. I get mean @ that point.

The fact that she tried to paint this "I'm a perfect driver and there's no way it's my fault" picture of herself is EXACTLY what pissed me off about it when I was listening.

Yeah the "i am perfect picture" pisses me off too.  I don't think there is enough info there to do anything though.  I mean it could have been the bikers fault.  Being a biker community we would tend to have a bias for the biker.

I say it is more likly her fault cause she probably didn't look behind her for a bike, she was probably watching the bumper of ther car next to her that she was going to get over in front of.  If the bike was hit by the side of the truck then her fault no doubt.  If he hit the rear of the truck that is were it gets hard.  But if he was spliiting lanes at such a rate of speed over that of other traffic that he couldn't stop in time in the second case i believe that the biker was riding dangerously.  I mean does anyone here lane split at 35 or 40 mph when traffic is moving 5 to 10 mph?  I hope not.

Case in point - need more details.

"I took out a motorcycle rider who was riding the dots."

Interesting way to put it, especially when she describes herself as a dirt biker. Taking someone out sounds more like a hit than an accident.

I don't doubt that it was an accident, but I agree with others who think the driver who "took out" the moto rider is in LaLa land. She sounds a lot more interested in covering her legal butt than she is in finding out about the wellbeing of the rider that's been in the hospital for a month (yeah, the one who didn't even have a scratch on him).

Yeah, she didn't really sound troubled at all about the rider just her butt.  And as a rider of dirt bikes she probably meant when she was a teenager.

It's good she wants to cover her ass, but she really doesn't seem to care about the rider.
