Ebay/picture "borrowing" question

So I am selling an extra GS500 seat I have on ebay.

I just found this asshat who stole my f%$king picture to use in his auction.  WTF!?  Do I have any recourse to get this douchebag to stop using my picture?

I just found out where to report him for intellectual property rights on ebay.  Hopefully he will at least loose his listing fees, hope he never comes back to ebay  :mad:

It was actually pretty easy when I found their policy that says you can't do that.  On the policy page, you just click: report abuse of this policy, or something to that effect, enter his auction number, yours, and your description of the abuse.  Then it says you will get a response from ebay in 24-48 hours.  Ebay has their shaZam! together; they don't want to lose any future sales

Hmmm... may have been a good idea, especially seeing as he's a new ebayer and may just be ignorant to the fact that it's not cool to steal someone else's pictures.  But I was ticked off when i found this and wanted to stick it to him right away.  He'll just get a little slap on the wrist anyway: Removal of the auction and loss of maybe $.50 worth of auction fees, if they even do that

what kind of @$$hole really gives a shaZam! if someone borrows a pic of a stock part?  maybe if it was a bank corbin bit or something laced in 24k gold that is one of a kind I could see but other than that?  who really gives a shaZam!?

wait are you sure that's your seat because he describes specific details like "blue dots of paint".  trying to disclose details in a "borrowed" pic usually means vaporware/scam.

I guess I'm the kind of @$$hole who gives a shaZam!.  I take pictures of my stuff to show what I have for sale, and what condition it is in.  If someone comes along and uses my picture, maybe it looks like I just stole the picture from somewhere else, and everyone uses it. 

Not only that but by posting my picture in his auction, he is implying that that is his seat in the picture.  I probably still wouldn't be happy, but it would be much better if he stated: "selling my seat, same type as shown in this picture."  But really, how lazy do you have to be to not take a picture of your stuff.

Maybe he doesn't have a camera.  Not everyone does.

Sure it would have been nice had he stated it wasn't the actual seat in the picture, but so long as he's not scamming anyone who does it hurt?
