Let me start by drawing a picture....somewhat....

                                    D

Imagine that's an intersection.  It's an intersection I go through every day.  It's an interesting intersection because coming from C you can't see B or D until you're on top of the intersection.  Coming from D you can't see B or C.  From B you can see D, but you yourself are invisible for a while because of a hill.  The thing they all have in common is "A"...a section of grass across from D is clearly visible from each direction.

I'm heading to work, coming from "D", Friday morning and I look across to area "A".  Now, this is a stop sign frequently enough ran that the county has piled up several yards of cotton hulls.  Someone has obviously hit these hulls.  It's anything but difficult to see the mangled mid-90's single-cab Dodge Ram about 75ft beyond the cotton hulls...especially with its one remaining tail and headlamp lit.  I consider going on to work but figure I'll look a little more into it and it takes half a second to see three seat backs through the cab.  Anyone familiar with single cab dodge rams?  Only two seat backs.  Not wanting to overly alarm myself I get out and start walking to the truck it doesn't take long to clearly see that someone was still in it.  The truck is cratered all around...clearly picked up on the cotton hulls and rolled once.  I run around to the driver's side and it's just shaZam! from front to back.  Door's cratered in and stuck closed, but all the glass is busted out.  The driver's head was covered in blood...old blood, to boot.  He had a good split going down the side of his skull and down behind his ear.  His face was all swollen.  I figured the man was dead.  I yelled, though, just to check, and got no immediate response.  I put my fingers against his neck to see if he had a pulse and if he hadn't moved his cold skin would have convinced me he was no longer among us.  He was still alive, though, just somewhere else.  Everytime he tried to speak all he did was spit, slobber and bleed.  I only got enough out of him to know his name was Pete.  I get out and call 911, and about that time one of the guys I work with drove up and decided to see what I was out doing.

Ultimately the man was alright.  He fell asleep is all.  No broken bones, but a good bruisin' to the brain...he can't walk for shaZam! but that's about the jist of his injuries, other than some cuts and scrapes.  The thing that gets me, though, is this:

We are 7 miles from an EMS station in Lubbock and 5 miles from Abernathy.  It took nearly 40 minutes for EMS to get there.

When EMS arrived they asked if we knew how long the man had been there.  I say we just found him but I think to reach under the hood of the truck...stone f%$king cold.  Not warm.  Not lukewarm.  That truck had been stopped there all night.

My point?  Avoid riding/driving around Lubbock County because, if you wreck, EMS won't get there anytime soon and you can wreck at a busy intersection where everyone in the world can see you but there's only two fucks in the whole damn county that will stop and help.

I had a man die on me because everyone wanted to rubber neck instead of help a fellow human. If I see someone in need of help, there's nothing more important at that moment.Especially if it's life and death. The man That died on me was riding a BIG F'n  Harley on a major highway(not an interstate).Still don't know his name or what caused his wreck.people just drove around his bike and him laying 80 feet in front of it.Cell phones were rare in those days.Three fire departments with ambulances and emts on stand by 24/7.Took over an hour and all of them are located on that highway less than 5 miles away.He could have lived.

Doesn't suprise me a bit Mak.  I've seen the same thing.

Good for you doing the right thing.  Not everyone has the guts to walk up to a crash, not knowing the condition of the people inside.  Sounds like you got to him just in time too.

Every zero you add to the tolerance adds a zero to the price.

If the product "fails" will the product liability insurance pay for the "failure" until it turns 18?

Wow, good save.  I hate it when people just pass by and hope that somebody else will come along to help.  I worked in a mortuary as an embalmer for a couple of years and saw some easily preventable accidents with various people.

Shoot, you were that guy's guardian angel for the day. Good karma for you. Good job man, you are living proof there's still some hope for mankind! Kudos to your bud, too.

way to go man. so many times I've seen people just keep driving when they witness an accident.

only took you a few minutes of the day, and you likely saved his life.

The only help I would render would be a phone call. Never a good idea to touch an accident victim.

My brother was sued after stopping to help someone in an accident only to be blamed for causing leg injury's by removing a lady from her BURNING  car  :dunno_white: I guess he could of just let her burn?

Sounds silly ehh? Well... she won the case, my brother paid THOUSANDS in damages to her  :flipoff:

i believe many states have "good samaritan" laws. if you DONT render possible aid to someone and they die, don't you think the family will sue you still? i'd rather err on the side of human life. treat others how you want to be treated. if i'm trapped in my burning car, by all means, get me the f%$k out. it's common sense really. stupid ass lawsuits like the one you mentioned make it really hard for real lawsuits to get the justice they are deserved.

Good sam laws are fine and dandy, they are exactly for this type of issue, a certified para professional or professional must stop and seek to render aid in most states and can be prosucuted under the law if they don't. What is even worse is when I was in California they were not covered by good sam law either so are at risk of civil liability. When I was a cerified para professional in the state of california I never ever ever ever wore anything or had any vehicle decals that indictaed what I did for a living or anything like that. As a lifeguard and a volunteer first reponder with an ambulance service I hod no civil suit protection if I was not on the clock at the pool or on duty with the ambulance crew. Do you think I was willing to stop for people?

Maks a good man, and now that I don't have the legal concerns because I have long since let all of my certificates lapse and refuse to take any certifcation classes I would be willing to stop and help now.

and people wonder why tort reform and the just sue mentallity is such an issue in the US.
Why didn't you just go the whole way and buy me a f@#king Kawasaki you bastards.

Texas does not have adequate good Samaritan laws, in my opinion:

Good Samaritan laws or not, I will always stop and make sure they're getting the help they need.
