A thought just occurred to me tonight, and it has me stunned:

Today's been a really crappy, painful day. I was laying on my bed thinking about the damned accident...then I sat up so hard it hurt like hell when a thought struck me.

OMG. I can't believe I didn't think of this Monday or yesterday.

The accident happened at about 6PM. We were in the diamond lane. THE OTHER DRIVER WAS IN HER CAR......****ALONE****. She was illegally in the carpool lane. What are the chances that she was diving out of the lane because she thought a cop was around as she chatted on her cellie!!??

So..while the biker behind me was calling 911, the other driver was on her cell (which had been glued to her ear when she got out of her car). About 5 minutes later, a car with I think 3 people pulls up, and a man gets out that I assume is her husband. I didn't think anything of it, because I figured he'd come to support his wife.

I didn't hear what statement they gave the cop, but what if s/he claimed that her husband was WITH her in the carpool lane!!!!???? OMG.

In my shock on Monday and Tuesday..and, heck, until tonight, it didn't even REGISTER that she was in the carpool lane ILLEGALLY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I don't know what this means for me legally, but I'm calling my insurance first thing in the AM (I just missed the closing of the claims office tonight). OMG. This has just stunned me all over again. She was in the carpool lane illegally, and her husband(?) shows up and sticks around while the rest in the car then leave...and she and the man (husband?) then talk to the officer together.

Does the fact that she was illegally in the diamond lane (alone in her car) have any bearing on the case?

Ugh..I'm just sick to my stomach thinking about the whole thing (and from gritting my teeth through the pain ).

Interesting how stuff like this starts to come out days later.  It's happened to me, replaying stuff over and over and over in your head.  It takes time for the details to come out.  I would definately make the police aware of that fact.

Just my opinion: unlawfully using a HOV lane generally isn't a moving violation, so I doubt either insurance company will care.  (Never hurts to mention it though)  I would stress the cell phone thing, especially is fogtown can verify she was on the phone.  A lot of states have adopted enhanced penalties for moving violations while using a cell phone, maybe you can get her off the streets for 6 months.

Pandy, I'm glad you're alright.  It could have been MUCH worse, even if the bike is totalled.  It sounds like your attitude survived!  :thumb:

We were in Paris for five days at the end of our trip.  The population density is something like 20x that of NYC -- tons of people in a tiny space.  Scooters and bicycles and motorcycles everywhere. Lane splitting is de rigeur.  I saw no one without a helmet, however.

Yes, you've pretty much nailed it here. I reported it to my insurance company, and they didn't care all that much. I also asked on a LEO forum, and they pretty much answered as you did above: the fact that she was illegally in the carpool lane doesn't have any bearing on blame/fault finding.

Things definitely do come out as I replay things over and over and over and ....etc...in my head. They seem so damned relevant and like such AHA! moments to me, but I think the only place it's really going to matter is if it goes to course (ie. if she told the police her hubby was with her, then she lied).

I've just got to hope that having a witness helps, and hope that she's not really evil, and hope that I'm not screwed just because I'm a big, mean, rough, tough biker chick.  :laugh:

Today I feel better. Yesterday hurt a LOT...a LOT.... I'm still hoping to go on a group ride tomorrow (crazy, maybe, but I'm still hoping). Did you get pics of the scooter-fest in Paris, trumpetguy??  :thumb:

You'll hardly see anyone riding without a helmet on this side of the pond...it's pretty much mandatory everywhere, even riding mopeds. :thumb:

The funny thing is that I don't even care about taking her to the cleaners. I just want everything set to rights, but I doubt that's going to happen. I've been told that it's a major miracle if I don't receive a percentage of the blame, even though I was doing nothing illegal and was not the cause of the accident.

The doc up'd the ante today, thank the moto gawdesses. Morphine and muscle relaxer....  :icon_twisted: The pain was getting unmanageable....but today's there's been some relief. Hopefully my muscles will calm down and start healing now. I so badly wanted to go on a coastal group ride tomorrow night, too.   :cry: Wonder if I should sell the morphine and get a new pipe... I keeeed, I keeeed...  :icon_lol:

Other than not being able to work, not being able to ride, being in pain, and feeling intense dislike toward one specific cager, life's not bad!LOLOLOL And I have insomnia...  :icon_rolleyes:

Insomnia happens with opiate based pain relievers, ask your Doc for Lunesta.  It doesn't adversely interact and works freaking awesome.
