Short Title: Motorcycles-No Passengers Under Age 16. (Public)

A BILL TO BE ENTITLED
AN ACT TO PROHIBIT THE OPERATION OF MOTORCYCLES WITH PASSENGERS
UNDER AGE SIXTEEN.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 20-140.4(a) reads as rewritten:
"(a) No person shall operate a motorcycle or moped upon a highway or public vehicular
area:
(1) When the number of persons upon such motorcycle or moped, including the
operator, shall exceed the number of persons which it was designed to carry.
(2) Unless the operator and all passengers thereon wear on their heads, with a
retention strap properly secured, safety helmets of a type that complies with
Federal Motor Vehicle Safety Standard (FMVSS) 218.
(3) With a passenger who is under the age of 16 years."
SECTION 2. This act becomes effective October 1, 2009, and applies to offenses
committed on or after that date.

Woah, no passengers under 16? Pretty weird. Is this a first? I'm not aware of any other places that do this. I still vividly remember my first motorcycle ride ever. I was about 12 years old and my uncle took me around the block on his Harley. I was totally hooked and from then on I knew that I had to get a bike some day some how. It took another 13 years for me to actually do it, but it was well worth the wait. That was in Delaware and there weren't even helmet laws, I just hopped on the back and went for a little ride around the block. I could see requiring parental consent, but outright banning everyone under 16 from riding on a motorcycle seems a bit much. Not like I'd have a problem with that, I don't have any kids or anything like that, so I can't really imagine a situation in which I'd have someone under 16 on the back of my bike anytime soon...

Unless you got really lucky at the bar, in which case there would be a new set of laws to worry about.   :laugh:

That freaking SUCKS.
My little boy is 7 and he LOVES to ride on the back.
I will only take him around our block due too I don't want him on the road with me and other cars but dang that's just messed  up.

I emailed the AMA, they tend to lobby for us motorcyclists, to see if they had any plans of attempting to modify the bill.

That isn't NC's only stupid ass law.
Insure 1 bike and its x lets say, insure a second bike and in many - most states its 5-10% of x. Unless its a higher risk category, then its its rate y say with the lwoer risk one being a 5% of y.
NC second bike is also x. Who set this up. BTW cancel insurance and you have to turn in your plates. Valid registration, dont matter. If you re insure it, you have to get whole new plates.
AMA is worthless. They fight  stupid stuff and never stop bragging about it.

Problem isn't IQ, the problem is that these people are professional "lawmakers" ... they make laws, as in they dont do any work in anything they are trying to legislate.

They dont ride, they dont drive, they legislate. Heck they dont even pay taxes, carry insurance or pay taxes.
So why the F*(k sould they care.

Last year the brought in a law that the minimum age for a pillion was 8, which I think is stupid, but 16 is crazy.

My eldest boy turned 8  amonth ago, so for his birthday he got a helmet, jacket & gloves.
The more I learn about women, the more I love my bike.

we ride around the yard, and once he can hold on proper (maybe 7-9 or so) i'll take him around the block.

i'll also teach him that there wasn't a meaningful law passed in the last 100 years.

again, f%$k the police. (ok, lawmakers, but FTP is cooler to say)
