cut off and went down on freeway today

i left work looking forward to a 4 day weekend.  i was slowly splitting lanes leaving san francisco heading for the bay bridge when this knuckle head    :nono:  in some red sports cars takes a hole shot and clips my front wheel.  down i go.   :o  lucky for me we were all going slow.  as i went down i thought here comes a car to run me over.  did not happen.   :thumb:  the loser did not even stop.  no damage to me, light scuff on exhaust and bar end.  really lucky.  i can't really even be mad at this nimrod.  he/she was just like everyone else in a car, totally oblivious.  i will be more carefull next time.  i have too far to go everyday to not.  the rest of you remember that people in cars are sheep at best just following the leader.  and looking for hole shots.

It was a hit and run, if someone clips your front wheel and makes you fall that's their fault. Splitting lanes is legal and if they hit you it would be treated the same as if they just slammed into the guy next to them. Doesn't matter that you're on a bike, if a guy was in his car hugging the lane next to them as people are so fond of doing and the guy slammed into his car's side it's still the guy who tried to switch lanes. If it had been me barring a disabling injury or catastrophic failure of the bike I'd get right up on the bike and chase the guy down, stop him and then get his info to the cops. He's still at fault. Sounds like a hit and run to me.

I mean it shouldn't be too hard to catch up to the guy if there's traffic. I would at least get his plate number and call the cops, they'd just love to bust a hit and run. Big money for you and big money for them too. Also people who drive like that shouldn't be on the road, bet he didn't stop cause he didn't have insurance, cops'll have a field day with that guy.

I'm just glad I don't live anywhere so busy that I would feel that splitting lanes was necessary.  I prefer to keep my distance from the big city!

I chased down someone after they hit me and took off.... becuase of "my wrecklessness" in chasing down the guy, they would have ticked me too for following him ??? AKA... If I want that driver ticketed... I get ticketed  :dunno_white:

Not entirely true, Alot of cops ride, I knew one that got sideswiped out in cali, didnt blow him off the road but he sure got on the side of them and kicked their door in... lol....

Fro what I was told @ the time of my 97 accident - Lane splitting is not illlegal, but any accident that occours while doing it is the splitters fault.

General exceptions are - getting rear ended, getting hit after you have moved to the lane by yourself (my case) and if you are sharing with another motorcycle only and you're hit by a vehicle other than the other motorcycle (that actually happened to a friend of mine).

in CA, lane splitting isn't illegal.  that doesn't mean it's legal either.  it's a bit of a loophole here - and is considered the same as passing/overtaking.  therefore, if you're passing someone, you can't be going more than 15mph faster than the person you're passing and you're supposed to be on the defensive at all times during the maneuver.

if you get hit because someone didn't see you, and you're going over a certain speed: you're boned.  if you get hit because someone didn't see you and you were within the law: you're boned unless a CHP was watching.  i'd say chase a little and get the plate and call it in after you get home or wherever you were going. 

just give the last 4 or five digits of the plate and a description - that way they don't think you were hunting the guy down afterward.  if it's a hit and run, and the car that hit you took some damage and you swapped a lil paint, you could make out very well in the end.

The guy was in an accident and didn't stop. It doesn't matter who started it, he's at fault now for hit and run. If you got any part of his plate, you should have called it in. Glad to hear you're OK though!

OP: sorry to hear. I scare myself sometimes lanesplitting. Unless stopped or very slow traffic it's usually not worth the extra 1.6 minutes you end up with getting to work.

I caught a hit and run driver. I got the money for parts from her insurance company. $600. If you are not hurt it's a misdemeanor hit and run.

Who said getting hit was a way to make "big money?" That is retarded. You're not going to make big money unless you got big hurt and racked up a big hospital bill and had big pain and suffering.

Insurance payout should be about fair compensation for real injury and damage.

Well you're not looking at Jacoby and Meyers sellements, "You know the story!  ;)" But insurance settlements should also include lost work time and other expenses related to the inconvenience of losing the bike, which is actually quite a bit. For example I am a student and could prove I commuted long distances for work and school, I had to argue the time lost by having to driving my car and purchase a parking permit and the gas that my car guzzles at 4 dollars a gallon, it was pricey back then, brought my settlement after getting rear ended from just hospital bills, to an extra $1000 on top. $3000 for just an x-ray and pain shot (but that's another ripoff entirely). But the fact is the insurance company is not about fair settlement of an accident, cause what I had to argue was fair settlement. The insurance company would love to stick you with all the bills if it weren't for that pesky contract you signed.

But historically insurance is supposed to be based on a distributed risk paradigm where costs of accidents are spread out over a population generally considered safe. The best example is a load of treasure going back by boat to another country. If there is a 1% chance of a boat sinking but you spread the treasure out over 100 boats, you'll likely lose a boat but only 1% of your treasure. The insurance takes a small commission for it's boat spreading service, not the whole treasure. This means everyone covered on the same plan should pay the same amount and that amount should not increase unless everyone in the group's increases as well because risk has gone up.

Instead as far as I can figure it they're ripping you off by putting you in a risk group of one, yourself only. It's not a group distributed risk it's a time distributed risk, basically a really high interest loan that you pay before you get in an accident and have to pay out, and then you pay for it again in raised premiums and fees. I know because of someone who cut me off and slammed brakes right after passing me. I was held at fault and the total damage to his and my car was less than the eventual fees and raised premiums I ended up paying for, he was uninsured too and I am still paying for it 4 years later. So I completely paid off the value of the accident in fees and raised rates, wtf were my premiums for? Lining pockets is all I can think of. So I don't consider it ripping any insurance company off for fair compensation when it's the insurance companies ripping everyone off to begin with, AIG ring a bell? Insurance seriously should not be the most profitable financial industry, shouldn't investment be? To me the fact that insurance is the most profitable automatically raises a flag that something fishy is going on.

I think if a pole was conducted on lane splitting you would find that most people do it regardless if it is law or not.

It is illegal here in Aussie but it is one of those rules that the cops do not worry about chasing people down for as they do it themselves on their cop bikes.
