Good bye my beautifull brand new 2008 GS500F

Last Wednesday i was commuting to work as usual. I was on the left most lane doing 80kms and my lane was empty. Suddenly a car on the right lane that was around 5 meters away from me puts it's left blinker on and merges to my Lane and stops in order to to go into a petrol station. I braked hard, the bike skid a bit but i never lost control and since it was raining and i was tooo close to the car, i hit it straight in the back ... I went flying over the car and landed on my back...  :icon_sad:
The good news is that i wasn't hurt, just soft tissue injuries, nothing broken... Thank god for helmets and leather jackets :)
Insurance called today and the bike is a total loss but again no big deal, i have comprehensive insurance  :)
The bright side of things, Insurance is  replacing it with a brand new one  :D

YOU have comprehensive insurance?? What about the guy who pulled infront of you and slammed on his brakes?? How's his insurance? I would expect him to have atleast GSXR750 quality insurance, maybe even z1000 quality insurance....

I don't know how the law works where you live but generally if there is a rear end accident you are at fault in the US. Is that the case here?

Yeah, if you just rear end someone that's your fault, but if someone pulls right infront of you and stomps on their brakes, that's completely their fault. Did you explain the situation to your insurance company, because I'm sure they'd be more than happy to make the other guys insurance pay for the repairs, instead of themselves. On the other hand, if you stood up and said "whoa, sorry man, my fault", then you're probably stuck. He'll probably say he didn't pull anywhere near you, and that you were just going sooooo fast that you didn't have time to react.

If you find this to not be true, I'm going to take my wife's nissan versa out onto the highway, pull 3 inches infront of someone an slam on my brakes, and see how much I can sue them for, so let me know what you find out.

If that guy was cited for unsafe lane change, its his fault, otherwise you ahve to make a big federal case of it ...
Hitting his rear quarter panel = his fault for not checking blind spot. Booya ... no question there.

That's the time to swerve into the lane he's vacated rather than braking.  The instinct is to brake, ja, but swerving takes much less distance and traction, provided there's an escape path (which, on the street, there almost always is - the shoulder, a gap between cars, etc).  That's where training comes in.  I'm a big fan of spending time now and then in a parking lot practicing swerving as well as emergency braking, so you can do it without hesitation when the situation demands.

PaulF - You're a european driver - UK, or the other end of the globe - Australian (or another country that drives on the left).  Guy cut you up and you smacked him in the rear.  His fault.  You were in the right.  f%$k questions about the insurance.  You're getting a brand new bike and you're not too badly hurt (I hope :o) - RESULT!!   :D :D :D :D

way I see it, the other driver should be considered at fault for whipping right over and slamming on the brakes in front of you.   maybe a video camera on your bike isnt a bad idea.  its hard to lie when the video says exactly what happened.
looking for a new vehicle again.

OH My god if all bikes had cameras there would be no drivers of 4 wheelers left. They would get so many tickets. I had this idiot lady yesterday at a light turn left right in front of me and gave me a dirty look as she did it. It was all I could do to down shift apply max front brake while swerving to miss her! Luckily there wasn't another idiot trying to do the same thing I would have had no where to go!

Any hoo just glad to hear he is OK and alive to ride another day. It's us against them it always has been. The thing is we're smarter and better looking no matter what country you ride in  :thumb:

The police said that initially i am not at fault since she cut my lane and braked just meters in front of me.
@Cafeboy, a car driver using his signals and not checking his mirrors means he is at fault mate. If that lady checked one of her 3 mirrors she would have seen me  :icon_sad:
A Camera is a good idea i think!! I'm gonna look into this ASAP!!!
My bike is already in an auction, i'm gonna try and get it back  :D
