I got robbed!

Yep.  But not here where I moved.  I sold all the yard equipment to the new buyer of my house.  For $1k I sold them 3 air conditioners, a riding mower, a puch mower, a new snowblower, a chain saw, a weed whacker and a small roto-tiller.

Well it seems that somebody broke into the shed within the last week (well after I was paid for the equipment and after I moved out) and stole everything but the AC units and riding mower.  The buyer, which closed today on my old home, wanted to claim the loss against MY homeowners policy.  I ended up having to return $600 to him at closing to get him off my back even though he retains the greater valued objects (the riding mower and AC units).  I got hosed.  The buyer suddenly wants more $ for the stolen goods than I asked of him.  Grrrr  :x

What bugs me is the buyer made no efforts to secure his property.  He should have realized that stuff around an unoccupied property is a tempting target for thieves.  But hey, I have a big "f%$k me" sign on my back right?  So it's my fault somehow -despite the buyer using some of the equipment to maintain the property over the last 3 weeks.

LESSON: [1] If you sell personal property outside closing make sure they either take possesion of it immediately upon payment. [2] Remember the old saying "No good deed goes unpunished"

Was that transaction written into the contract for the house?  If not, I'd have told him to go shaZam! in his hat, or something equally eloquent.

I may be talking out of my ass here, but did you happen to consult some knowledgeable person about the law involved in such a situation?  I can't see that you have any liability at all.

god that'd be funny. bring a sledge and just destroy everything. then leave the scrap in the yard. if the shed is in the yard but it's still your responsiblity, then the 3 busted ass a/c units can be yours till he moves in too. free of charge.

sounds like the di**head's  taking advantage of your not being present at the closing. Get a police report maybe?
Kharmically, it's like NE saying "good riddance" and making you pay a little more for a positive change in your life. I swear New England's haunted.  :dunno:

Well the property was listed in a seperate contract -itemized piece by piece.  The problem is that seeing it was still my property he can claim against my homeowners insurance.

So it went like this:  The buyers suddenly got a bad feeling for the new house, considered backing out the day of the closing and had to be verbally Buddha Loves You slapped by the realtor into going ahead with the closing.  I had to give the buyer $600, who knows what the realtor gave back in addition to that amount?  I'm just glad the deal is over, I got my money (less the $600) and that's that.

Am I upset?  Well yes because there was no duty of the buyer to secure the property.  He could have left it all at the end of the driveway if he wanted and I would still be responsible.  And who knows who really took the stuff?  Could be anyone from the buyer to neighbors to drifters.

Anyway, this really was a nice boot in the ass from NE to us as we leave.   Sure leaves a sour taste in our mouths.  Next time I put in the contract that the buyer takes full responsibility for ANY property paid outside of closing at the time of payment.

Oh yea, it did stick in my craw that the real estate agent was so quick to tell me I was responsible.  He obviously wanted to save the sale.

Oh well.  Things are looking up.  I have $ in the bank, good health, lots of hard classes to take and a roof over my head.  I'm all set :)

ps.  I wanted to do a Pantablo move!  I really did offer to give back the $1000 and have ny brother in law come get the riding mower and 3 AC's.  I would have prefered to give away those items rather than let him get them for $400.  But it's all water over the dam now...
