Janklow gets old life back (this is so wrong)

This was important enough to me to jump back in here to share this.

Seems in SD you can kill another human being, serve 100 days in jail, 3 years probation and have a friendly judge grant you a clear record as if Randy Scott never existed. Janklow has also returned to practising law...........

Janklow's probation ends with clean record

Former U.S. Rep. and four term Governor Bill Janklow emerged from his manslaughter probation this week with a clean record. Three and a half years ago he sped through a stop sign and killed motorcyclist Randy Scott from Hardwick MN. Scott was killed instantly. Janklow suffered minor injuries. Janklow served a mere 100 days in jail, paid a $5,000 fine, temporarily lost his law license and was forbidden from driving during his probation.

His record will be cleared because Circuit Judge Rodney Steele, now retired, issued Janklow a suspended imposition of sentence in 2004. A suspended impostion of sentence is similar to a pardon and means that a judge has placed the jury's guilty verdict on hold. There is no conviction on record if a person complies with all conditions specified as punishment by the judge. A judge can grant this one time pass if the judge believes justice and the best interests of the public and the defendant will be served.

Scott's family has filed a wrongful death lawsuit. The federal government will be responsible for any damages awarded because Janklow was on official business when the accident happened.

I guess motorcyclists arent considered part of the public????

I suppose getting killed was in Randy Scott's best interests....

WTF!  Man that is so f'ed up, he should ironically be run over by a pack of motorcyclists.  How a judge can rule that it is fair to one man to spend 100 days in jail and 3 years on probation for killing a man and it simply dissapears is beyond me.

And pablo is saying it is f'ed up as well, not that it was in the publics best interest that Mr. Scott be killed by an inattentive asshat like Janklow.  But that its f'ed up that Janklow has nothing on his record now because a judge ruled that way.

If I made a mistake and killed someone...  Then was found guilty of manslaughter... THEN was let out early...

Every single criminal court I've ever walked into grants SIS's.  I think I could have gotten the same deal for any of you.   Assuming you had no priors. 

I'll say it again: an attorney could get any one of you an SIS for a lot of the crimes you could be prosecuted for, (assuming you had no priors) and guess what , after your probationary period, you're record would be clean.


This is how the system works.  The one thing I'll say about it is that 3 years SIS seems pretty short, but I'd warrant he did a lot of other stuff they didn't mention here as a condition to his probation.  And pretty much any criminal that gets convicted in a state court will only actually serve half their sentence.  That means on a 7 year sentence, out in 3.5.  Felons.

You know...  After freaking out about the SIS (I'm assuming that means that your record is cleaned after X time), I found out that a friend of mine will most likely be getting one for her (reduced to) Reckless Driving charge...

I've never heard of anyone I know getting one (before yesterday)...  But, I've heard plenty of times about some random rich person or politician getting one.

It must be the fault of the Liberal Media.   :laugh:
